CHAP. 82.—An ACT appropriating money for the payment of com-
mutation to maimed soldiers, sailors and marines, in lieu of artificial
limbs or eyes herctofore provided by law.
Approved February 8, 1879.
1. Be it enacted by the general assembly, That the sum of
fifteen thousand dollars be and the same is hereby appropriated
out of the public treasury, to be paid as is hereinafter provided,
to such soldiers, sailors and marines as have not heretofore re-
ceived artificial limbs or eyes, or commutation in money for the
same under any of the acts of the general assembly heretofore
passed for that purpose, and are entitled to the same in ac-
cordance with the provisions of said acts: provided that per-
sons who are bona fide citizens cf the commonwealth, and
during temporary absence therefrom, enlisted in the regiments
of other states shall be considered as within the purview of this
act, and shall, upon hke proof as is required heretofore in cases
of Virginia soldiers, be entitied to the benefits of the same:
provided further, that this provision shall not apply to those
persons who have received limbs or eyes. or commutation in
lieu thereof from other states. P
2. The auditor of public accounts is hereby authorized to
issue his warrants on the treasury to pay the claims properly
allowed under this act; and the same shall be paid out of the
money appropria‘ed by the first section of this act, in the
order of time in which such claims may have becn transmitted
or may hereafter be transmitted to the auditor as aforesaid.
3. The auditor of public accounts shall make no payment
under this act until the first day of August, eighteen hundred
and seventy-nine, and shall then divide the amount hereby ap-
propriated equally among ail who may then appear to be entitled
to receive anything under this act: provided that no one shall
receive more than sixty dollars.
4. This act shall be in force from its passage.
