Chap. 25.—An ACT to incorporate the town of Daniel, in the
county of Campbell.
Approved January 14, 1879.
1. Be it enacted by the general assembly, That the town of
Daniel, in the county of Campbell, as the same has heretoforo
been, or may hereafter be laid off into lots, streets, and alleys,
shall be and the same is hereby made a town corporate by the
name of Daniel, and by that name shall have and exercise the
powers conferred upon towns by the fifty-fourth chapter of the
Code of Virginia of eighteen hundred and seventy-three, and
be subject to all the provisions of said Code, and to all laws
now in foree, or which may hereafter be enacted in reference
to the government of towns of less than five thousand inhabi-
tants, so far as the same are not inconsistent with the provi-
sions of this act. But no citizen af said corporation shall be re-
quired to work on the public roads, nor required to pay school tax,
save such as is levied by the state, or by the common council
of said town; nor shall any citizen be required to pay any
road tax, but the common council may require the streets to be
kept in good order, as hereinafter provided.
2. The boundaries of the said town shall be as follows:
Beginning at the abutment of the bridge of the Washington
City, Virginia Midland and Great ‘Southern railroad, across
the James River and Kanawha canal, on the line of the corpo-
ration of Lynchburg; thence with the line of the corporate
limits of Lynchburg to Blackwater creek; thence along said
creek up to the bridge crossing said creek at Lollins’ mill;
thence along the line of the Lexington turnpike to the line of
the Puckett place; fhence along the dividing line between the
Puckett place and the estate lately belonging to Judge William
aniel, Junior, to the James river and the line of Amherst
county ; thence with the Amherst line down the James river
to the beginning.
8. The jurisdiction of the corporate authorities of said town
shall extend one mile beyond and outside of the limits thereof,
and for imposing and collecting 1 license tax on all shows, per-
formances, and exhibitions, which shall take place anywhere
within said extended boundary: provided that said jurisdic-
tion shall not include any portion of the corporate limits of
Lynchburg, or of the county of Amherst.
4, There shall be elected annually, on the fourth Thursday
in May, one elector of said town, who shall be denominated
mayor, and six other electors, who shall be denominated the
councilmen of said town. The mayor and councilmen shall
vonstitute the council of said town. The persons so elected
shall enter upon their duties on the first day of July next suc-
ceeding their election, and shall continue in office until their
successors are elected and qualified. Neither the mayor nor
any councilman shall receive any salary or other compensation
for their services.
5. All male persons shall be compellable to work three days
in each year on the public streets, (excepting ministers of the
gospel, persons under sixteen or over sixty years of age, and
old or infirm persons, who are unable to perform manual labor),
and to attend for such purpose upon the call of the commis-
sioner of streets. For every days’ failure to perform such ser-
vice, sueh person shall pay a fine of eighty cents to the town
treasurer, upon, the report of the street commissioner to the
effect that he has so failed. If the fine be not paid, it shall be
recoverable by the treasarer, with costs, before the mayor, who
shall issue a writ of fieri facias for such fine and costs against
the person in default, if he be of full age, otherwise against
his parent or guardian.
6. The council shall elect annually a town sergeant, and a
treasurer, and such other officers as may be needful for the
town covernment, and fix their duties and compensation so far
as consistent with the general laws of the state; and one per-
son may fill more than one office. The sergeant shall have the
same powers aud discharge the same duties as a constable
within the corporate limits and jurisdiction of the town. The
council shail also elect annually or employ a commissioner of
streets, who need not be a resident, and prescribe his duties
and compensation. The council shall also appoint, as soon as
it may be deemed expedient, an assessor of the value of all
lands and lots, together with the improvements thereon, and
shall require of him such bond, with good security, as they
shall see fit, conditioned for the faithful performance of the
duties of his office; and said bond shail be given before the
judge of the county court of Campbell county, in the manner
provided for in section two, chapter thirty-two of the Code of
Virginia of eighteen hundred and seventy-three.
7. From and after this act goes into effect, and until the
councilmen to be elected under its provisions shall have been
elected and qualified, the following persons shall be council-
men for the town, with all the rights conferred by this act,
to-wit: Henry Poole, Stephen Padgett, W. R. Kirby, W. E.
Furcron, Marion Marsh, R. J. Wilkins, and James E. Karnes;
and at their first meeting the said councilmen shall elect one of
their number, who shall be mayor of the town for and during
said period, Every person appointed as councilman under this
act, or elected mayor or councilman under its provisions, shall
take an oath before the judge or a justice of the peace of the
county of Campbell to execute the duties of his office to the
best of his judgment.
8. The rate of taxation levied by the corporate authorities
shall not exceed the rate levied by the state for state pur-
poses.
9. This act shall take effect on the first day of February,
eighteen hundred and seventy-nine.
