Chap. 242.—Au ACT fo ineorporate the town of Madison. in the
county of Amlbierst,
Approved March 3. 1879.
i. Be it enacted by the general assembly, That the town of
Madison, in the county of Amherst, as the same has heretofore
been, or may hereafter be laid off into lots, streets and alleys,
shall’ be and the same is bereby made a town corporate, by the
nae of Madison; and by that name shall have and exercise
the powers conferred upon towns by the fiftv-fourth chapter of
the Code of Virginia of eighteen hundred and seventy-three,
and be subject to all the provisions of said Code, and to all
laws now in force, or which may hereafter be enacted in reference
to the government of towns of less than five thousand inhahi-
tants, so far as the same are not inconsistent with the provisions
of this act. But no citizen of said corporation shall be re-
quired to work on the public roads, nor required to pay any school
tax, save such as is levied by the state, or by the common coun-
cul of said town; ner shall any citizen be required to pay any
road tax, but the common council may require the roads to be
kept in good order as hereinafter provided: provided, however,
that the citizens of said town shajl not participate in any county
or district school tax levied by the county of Amherst in the
district In which said town is located.
2. The boundaries of said town shall be as follows: Begin-
ning on east abutment of toll bridge; thence north eighteen
anda half degrees, west six hundred feet with low water mark ;
thence north ten degrees east, one thousand two hundred and
fifty feet up James river, with low water mark; thence north
fifty-two and a half degrees east, one thousand three hundred
and fifty feet up bluff with branch; thence north forty-one de-
grees east, four hundred and sixty feet with Camp's line: thence
north fifty degrees east, one thousand eight hundred and fifty
feet to Going’s and Salmon’s corner; thence north thirtv-four
and a half degrees east, six hundred feet to Frederickson’s cor-
ner; thence south sixty-nine degrees eas., one thousand feet
with FKrederickson’s line to main road: thence south thirteen
degrees west, five hundred and fifty feet with mam road (north
side); thence south nine and a half degrees cast. seven hundred
and ten feet to intersection with Folly road; thence south
seventy-nine deerces east, six hundred and fifty feet down Folly
road (south side); thence south thirty-cight degrees east, two
hundred and forty feet down Folly road (south side); thence
fifty-eight degrees east, two hundred and thirty feet down Folly
road (south side); thence north eighty-one and a half degrees,
one handred and thirty feet down Folly road (south side) ; thence
south thirty-one and a half degrees west, seven hundred and
eighty feet, crossing branch, and thence with Morgan’s line ;
thence south nineteen degrees west, two thousand five hundred
and fifty feet with Wood’s line; thence north eight degrees
west, one thousand two hundred and eighty feet to corner of
Morriss’ farm on ridge; thence south two degrees east, seven
hundred and eighty feet to branch; thence south sixty-seven
degrees west, two hundred and fifty feet dewn hranch to Mor-
riss line; thence south fifty-cight degrees west, three hundred
and sixty feet down branch with Morriss line; thenee souta
eighty-six and a hali degrees west, one hundred and thirty reet
down same; thence south forty-eight and a half degrees west,
three hundred feet down same; thence south fifty-two degrees
weet, two hundred and eighty feet down same: thence south
thirty-five and « half degrees wost, three hundred and forty feet
down same to James river; thence north fifty-two degrees west,
one thousand feet up river; thence north forty three and a halt
degrees west, five hundred and sixty feet up river; thence north
twenty-eight and a half degrees west, nine hundred and eighty
feet to the beginning.
3. The jurisdiction of the corporate authorities of said town
Shall extend one mile beyond and outside the limits thercof,
and for imposing and collecting a license tax on all shows, per-
formances and exhibitions which shall take place anywhere
within said extended boundary: provided that said jurisdiction
shall not include any portion of the corporate limits of the city
of Lynchburg, or of the county of Camphell.
4. There shall be elected annually on the fourth Thursday in
May one elector of said town, who shall be denominated mayor,
and six other electors, who shall be denominated the council-
men of said town. The mayor and councilmen shall constitute
the council of said town. The persons so elected shall enter
upon their duties on the first day of July next succeeding their
election, and shall eontinue in office until their successors are
clected and qualified. Neither the mayor nor any councilman
shall receive any salary or other compensation for their ser-
vices.

5. All male persons shall be compelled to work three days
in each year on the public streets (excepting ministers of the
gospel, persons under sixteen or over sixty years of age, per-
sons who have lost a leg in war, and old and infirm persons
who are unable to perform manual labor), and to attend for
such purpose upon the call of the commissioner of streets. For
every day’s failure to perform such service, such person shall
pay a fine of eighty cents to the town treasurer, upon the report
of the street commissioner to the effect that he has so failed.
If the fine be not paid, it shall be recoverable by the treasurer,
with costs, before the mayor, who shall Issue a writ of fieri
facias for such fine and costs against the person in default, if
he be of full age, otherwise against his parent or guardian.
6. The council shall elect annually a town sergeant and a
treasurer, and such other officers as may be needful for the
town government, and fix their duties and compensation, so far
as consistent with the general laws of the state; ancl one per-
- gon may fill more than one office. The sergeant shall have the

same powers aud discharge the same duties as a constable
within the corporate limits and jurisdiction of the town. The
council shall also elect annually, or employ, a commissioner of
streets (Gvho need not be a resident), and prescribe his duties
and compensation. The council shall also appoint, as soon as
it may be deemed expedient, an assessor of the value of all
lands and lots, together with the improvements thereon, and
shall require of him such bond, with good security, as they
shall see fit, conditioned for the faithful performance of the
duties of his office, and said bond shall be given before the
judge of the county court of Amherst county, In the manner
provided for in section two, chapter thirty-two, of the Code of
Virginia of eighteen hundred and seventy+three.
7. From and after this act goes into effect, and until the
councilmen to be elected under its provisions shall have been
elected and qualified, the following persons shall be couneil-
men for the town, with all the rights conferred by this act, to-
wit: N. H. Ilazlewood, W. UW. Mahone, EK. J. Deaton, J. B.
Walton, L. F. Wood, EB. C. Floyd, and W.N. Proffitt; and at
their first meeting, the said councilmen shall elect one of their
number, who shall be mayor of the town for and during said
period. Every person appointed councilman under this act, or
elected mayor or councilman under Its provisions, shall take an
oath before the judge or a justice of the peace of the county
of Amherst to execute the duties of his office to the best of
his judgment.
8. The rate of taxation levied by the corporate authorities
shall not exceed the rate levied by the state for state pur-
poses.
9. This act shall take effect on the fifteenth day of Feb-
ruary, eighteen hundred and seventy-nine,
