CHAP. 239.—An ACT prohibiting non-residents hunting, shooting,
trapping, or netting partridges in the counties of Accomac and
Northampton.
Approved March 3, 1879.
1. Be it enacted by the general assembly of Virginia, That
no person who is nota resident of this state shall hunt, shoot, or
take or catch, with nets or traps, partidges in the counties of
Accomac or Northampton, without the written consent of the
owners Or occupiers of the lands on which they nunt, shoot.
trap, or net.
2, Any person or persons violating the provisions of this act
shall pay a fine of not less than fiffy nor more than one hun-
dred dollars, with costs, recoverable before a justice of the
peace; and on failure after conviction to pay the fine and costs,
shall be imprisoned in the county jail not less than one nor
more than three months.
3. In any prosecution under this act against a person or per-
sons, the fact of such hunting, shooting, netting, or trapping
shall be evidence of the guilt of such person or persons, whether
the game referred to be killed or taken or not. One-half of said
fine shall go to the informer, and one-half to the free school of
the county m which the offence was committed.
4. Any person offending against this act may be arrested,
with or without warrant, by any citizen of this commenweaith,
and taken before a magistrate for trial.
2. No person shall be considered a resident of this state
within the meaning of this act who shall not have actually re-
sided and domiciled within the limits of the state eighteen
months next preceding the time when the supposed offence
may have been committed; and in all questions that may arise
as to residence under this act, the onus probandi shall rest on
the defendant.
6. This act shall be in force from its passage.
