Chap. 199,—An ACT to amend section 12 of an act entitled an act to
provide for the division of school districts into sub-districts, and for
the appointment of school directors, approved March 7, 1878.
Approved March 3, 1879.
1. Be it enacted by the general assembly of Virginia, That
section twelve of an act entitled an act to provide for the
division of school districts into sub-districts, and for the ap-
pvintment of school directors, approved March seventh, eigh-
teen hundred and seventy-eight, be amended and re-enacted so
as to rend as follows:
$12. Except m the counties of Fairfax and Loudoun, this
act shall not apply to counties in which the county school hoard
shall, after due consideration, adjudge its provisions to be un-
suited to its county, and as calculated to impair the successful
working of the public school svstem therein: provided further,
that aiter a trial of one year of the operation of this law in the
said eounties of Fairfax and Loudoun, the county school board
of either county, or any twenty-five heads of families whose chil-
dren have attended the public schools may, if in their judoment
the operation of the law be deemed injurions to the interests of
education, apply to the state board of edueation for relief,
wherenpon it shall be the duty of the state board of edneation
10 male all needful enquiry as to the facts in the case, and it
shall have power, and it shall be its Guty either to coufirm the
law in its operation, or to suspend its action in these counties,
according as the said board may deem best for the interests of
public education therein.
2, This act shall be in force from its passage.
Oap, 200.—An ACT to anthorize school trustees to permit unused
and unoecupied publie free school-houres lo be occupied by teachers
other than those employed by school trustees.
Approved March 8, 1879.
1. Be it enacted by the general assembly of Virginia, That
where in any school district the school-house belonging to the
public free school of said district is unoccupied and unused for
public free school purposes, because of want of sehool funds
to employ a teacher therefor, it shall be lawful for the school
trustees for the district in which said school-house is situated
to permit the same, under such regulations and rules as to them
may seem proper, to be occupied and used for school purposes
by any teacher, though not employed by saii scl.coi board:
provided, that such arrangement shali not in any wice interfere
with or prevent said school-house being occupied and used at
any time by said trustees for public free school purposes.
2, This act shall be in force from its passage.
