CHAP. 148.—An ACT to incorporate the town of Bangs, in Mont-
gomery county.
Approved February 27, 1879
1. Be it enacted by the general assembly of Virginia, That
the town of Bangs, in the county of Montgomery, as the same
has been or may be laid off into lots, streets, and alleys, shall
be and the same is hereby made a town corporate, by the name
of the Town of Bangs; and by that name shall have and exer-
cise the powers conferred upon towns by and be subject to the
provisions of the fifty-fourth chapter of the Code of eighteen
hundred and seventy-three, and acts amendatory thereof, so
far as the provisions of the same are not inconsistent with the
provisions of this act.
2. The boundaries of said town shall be as follows: Begin-
ning at southeast corner of W. C. G. Myers’ blacksmith shop:
thence north with said Myers’ lot to western corner of colored
Baptist church lot; thence across the road to said corner;
thence east to the eastern corner of Glenn Latimer’s lot;
thenee north to northern corner of said lot; thence west to
southwest corner of J. L. Taylor’s lot; thence north to the line
between J. L. Taylor and the land of the Atlantic, Mississippi
and Ohio railroad; thence east, following the line of J. L.
Taylor’s lot to the north corner of Mistress J. W. Montague’s
lot; thence-south to the north corner of Glenn Latimer’s lot;
thence south with said Latimer’s lot to a point opposite the
western corner of J. N. Jordan’s stable lot; thence across the
street to said corner, and east to east corner of J. N. Jordan’s
stable lot; thence north to the land of Atlantic, Mississippi
and Ohio railroad ; thence east to east corner of Atlantic, Mis-
sissippi and Ohio railroad land; thence north across Atlantic,
Mississippi and Ohio railroad to north side of same; thence
following the line of same to east corner of J. H. Kipps’ lot;
thence north to a point opposite northeast corner of Taylor
McNorton’s lot; thence west to Mistress Stevens’ lot; thence
north to, north corner of said lot; thence northwest to south-
east corner of D, A. Brown’s lot; thence north with D. A.
Brown’s line to point opposite northeast corner of Robert
McNorton’s lot; thence west across Blacksburg road to north-
west corner of Baptist church lot; thence southwest to north-
west corner of John B. Davis’ lot, near Robert G. Latimer’s
orchard; thence south across the Atlantic, Mississippi and
Ohio railroad to the line between same and H.-D. Wade;
thence east with a line of said railroad to the northwest corner
of D. A. Brown’s lot; thence south to the southwest corner of
same; thence following the Christiansburg turnpike on the
north side thereof to the road from H. D. Wade’s mill, near
Myers’ shop; thence across the turnpike to the beginning.
3. The officers of said town shall consist of seven trustees,
who shall compose the council, five of whom shall constitute a
quorum to transact business, and a sergeant, who shall hold
their offices for two years, and until their successors are elected
and qualified. The said council shall have power to pass all
by-laws and ordinances necessary for the proper government of
said town (not in conflict with the constitution and laws of the
state or of the United States), and also to provide for keeping
the streets in order and paving the same, and for other neces-
Sary improvements.
A. The council shall etect from their own number a presi-
dent, who shall preside at all the meetings of the council, and
when they are equally divided, shall, in addition to his indi-
vidual vote, give the casting vote; and he shall be invested
with all the powers of a justice of the peace within the limits
of said town.
5. 1. P. Stearns, R. KE. Hatcher, W. C. G. Myers, J. I. Kipps,
I). A. Brown, Thomas Wilson, and J. W. Jones are hereby ap-
poiated trustees of said town, and sha‘l have and exercise all
the powers herein granted to said officers, and remain in office
unui! their suecessors shall be elected and qualified according
to law.
6, The sat counc!! shall, when organized, and every two
years thereafter, appoint a sergeant, who shall be.a conserva.
tor of the peace, and be invested with the full powers of a con-
stable within the limits of said town, and also have power to
arrest offenders within one mile of said limits for offences
committed therein: provided, that on the south side of said
town he shall be limited to the lines of the Christiansburg cor-
poration. -
7. Phe said council shall have no power to enforce a tax.
8. Phis act shall not be coastrued as exempting cither per-
sons or property in the town of Bangs from service on roads or
from county or road levies or taxes, under existing laws or laws
that may hereafter be passed, unless such laws shall exempt the
same by name.
