Chap. 1.—An ACT to incorporate the Union Bridge Company.
Approved December 18, 1878.
1. Be it enacted by the general assembly, That it shall be
lawful to open books at the town of Danville, in the county of
Pittsylvania, under the superintendence and direction of T. I.
Holland, James M. Walker, Thomas J. Corbin, Thomas D.
Stokes, W. J. Crews, J. M. Hutchings, and J. M. Neal, any
three of whom may act, five days’ notice thereof being first
published in one of fhe newspapers of said town, for receiving
subscriptions to an amount not less than seven thousand dol-
lars, and not more than fifteen thousand dollars, to be divided
into shares of fifty dollars each, for the purpose of building a
bridge across Dan river, at said town, from some point on the
southern bank of said river, either above or below the upper
lock of the canal; but if that point be below the said lock, it
shall not be less than one hundred yards, nor more than four
hundred yards below the said upper lock; thence across the
Dan river to some convenient poiat upon the opposite bank of
said river, and for the purpose of constructing a road to con-
nect the southern end of said bridge with Union street, in the
said town, and the northern end of said bridge with some con-
venient point on the new Henry county road.
2. As soon as one hundred shares shall have been subscribed
for, the acting commissioners shall call a general meeting of
the subscribers, at some convenient place in said town, publish-
ing notice of the time and place of such meeting for at least five
days previous in one of the newspapers aforesaid, and there-
upon the said subscribers, and such others as may thereafter be
associated with them as stockholders, shall be and are hereby
incorporated and made a body politic by the name and style of
the Union Bridge Company, and by that name may sue and be
sued, and have all the powers, rights and privileges, and be sub-
ject to all the duties and restrictions prescribed for joint stock
companies by the fifty-sixth and fifty-seventh chapters of the
Code of eighteen hundred and seventy-three, as far as the same
are applicable to bridge companies, and are not inconsistent
with the provisions of this act.
3. For the purpose of constructing said bridge and roads, the
said company may purchase and hold the land on which the
bridge and roads shall be located, or the right of way over the
same, as far as may be necessary; and if the president and di-
rectors of the said company cannot agree for the purchase with
the respective owners of said land, or the right of way over the
same, they may proceed to have the same condemned for the
purposes aforesaid in the manner prescribed for internal im-
provement companies by the said fifty-sixth chapter of the
Code.
4. The said bridge shall be constructed with stone piers, and
in such manner as not to interfere with the navigation of the
river or the passage of fish therein; no piers shall be located
on the north side of the canal nearer to the water in said canal
than forty feet, and the space between the canal bank and the
pier nearest to it shall be filled up to high-water, so as to pre-
vent the flow of the river between the canal bank and that pier,
and in crossing the said canal and canal bank the superstruc-
ture of the bridge shall shall be elevated at least seven feet
above the level of the water at the head of the canal and the
present dain so as not to hinder or obstruct the navigation of
the canal or transportation by wagons along the canal bank.
The said bridge shall be at least eighteen fect wide between the
railing on either side thereof and shall be commenced within
one year and completed within two years after the passage of
this act.
5. At any time after the completion of the bridge, the com-
pany may demand and receive such tolls for passmg over the
same as the president and directors may, from time to time
prescribe, not exceeding the following: For each person, five
cents; for each horse, ule or work-ox, five ecnts; for each
wagon, cart or dray, three cents per wheel; for every other car-
riage or vehicle on wheels, three cents per wheel; for cach head
of neat cattle, three cents; for each hog or sheep, one cent.
6. The capital stock of said company may be increased by
any general meeting of the stockholders to any sum not ex-
ceeding twenty-five thousand dollars.
7. This act shall be in force from its passage.
