Chap. 92.—An ACT to authorize Henry C. Douthat, of Botetourt
county, to establish a ferry across James river in said county.
Approved February 20, 1878.
1. Be it enacted by the general assembly, That it shall be
lawful for Henry C. Douthat, of the county of Botetourt, to
establish and keep a ferry across James river, from some
point on his land at or near Lick run in said county, to some
convenient point on his land on the opposite shore of said
river: provided the said Douthat shall, within three months
from the date of the passage of this act, provide and have
in readiness for use at the ferry, at least one flat-boat of
dimensions sufficient for the transportation of any ordinary
vehicle, and shall have in readiness hands sufficient for the
proper and safe management of such boat.
2. Unless the county court of said county shall, after due
proceedings had in said court, fix other rates of ferriage, the
rates at such ferry shall be as follows, to-wit: For every per-
son, five cents; for every horse, five ceuts; for every mule,
five cents; for every auc ‘ck, five cents; for every work-ox, five
conts; for every head of neat cattle, three cents; for every
sheep, one cent; for every hog, one cent; for every sroat, one
cent; and for ev ery ve diiele, five cents tor each wheel thereof,
3. The ferry here ‘by authorized to be est: ublished, shall be
subject to all the rules, regulations, conditions, and penalties
prescribed by general statutes now in force or hereafter to
be enacted, governing ferries established under the provisions
of chapter sixty-four of the Code of eighteen hundred and
seventy-three, and the proprietor of such ferry shall be enti-
tled to all of the rights, privileges, and remedies given to
bim as such under said statutes, and for all purposes the said
ferry shall be deemed to have been established under the
provisions of said chapter of said Code: provided, however,
that the franchise hereby granted, shall also be, at all times,
subject to the control of the general assembly, and may be at
any time revoked by it.
4. This act shall be in force from its passage.
