Chap. 5.e—-An ACT to amend the act entitled an act to incorporate the
Lee monument association, approved January twenty-fifth, eighteen
hundred and seventy-one..
Approved December 29, 1877.
1. Be it enacted by the general assembly of Virginia, That
the act entitled an act to incorporate the Lee monument
association, approved January twenty-fifth, eighteen hundred
and seventy-one, shall be, and the same is hereby amended
by the addition of the tollowing sections:
§7. Before the board of managers shall contract for the
execution of the equestrian statue of General Robert HE.
Lee, they shall notify the governors of the southern states
(excluding Virginia) contributing thereto, and it shall be
lawful for the several governors of such states to appoint
commissioners on the part of such state, not exceeding three
in number, citizens of, and residents in their respective states ;
who, with the board of managers, shall constitute a board of
commissioners, whose duty it shall be to select the artist
who shall execute the work, upon competition or otherwise
as to the said board of commissioners shall seem best, and
no award shall be made except upon the vote of the states
so contributing to the execution of the said statue—each state
casting One vote.
§ 8. If the governor of any such state shall fail to uppoint
one or more commissioners as aforesaid, or if no commissioner
from such state will act when thereto requested by the board
of managers, then it shall be for the board of managers of
the Lee monument association to supply such vacancy in the
manner prescribed for the appointment by the. governor of
such state.
§9. The object of this act being simply to sevure to the
states contributing to the equestrian statue of General Lee
an equal voice, one with the other, -in the selection-of the
artist for its erection, it is hereby expressly provided that
when such selection shall have been made, then the said
board of commissioners shall be functus officio.
2. This act shall be in force from its passage.
