Chap. 305.—An ACT to amend and re-enact sections 4 and Sof ati ‘att
to incorporate the Virginia Midland mining and manufacturing comr-
pany, approved March 80th, 1875. Ob RR,

1. Be it enacted by the general assembly, That sections
four and five of an act to incorporate the Virginia Midland
mining and manufacturing company, approved March thir-
tieth, eighteen hundred: and seventy-five, be amended and re-
enacted so as to read as follows:
§4, That said company shall have power to operate and
work in the counties of..Campbell,. Pittsylvania, Franklin,
Henry, Patrick, Albemarle,: Greene, :Orange, Amherst, Nel-
son, Madison, Gulpeper, Rappakannock; Fauquier, Warren,
and Shenandoah, and that any of the corporators may put
into the capital stock ‘of said company and lands owned by
them in any of: the said counties, to be held in fee simple by
said company...
§5. That. said company may, for the purpose of transpor-
ting the productions of their mines and manufactures, con-
struct, maintain, and operate railroads of broad or narrow-
gauge, or tramways from their mines or any of them in the
said counties of Campbell, Pittsylvania, Franklin, Henry, Pat-
rick, Albemarle, Greene, Orange, Amherst, Nelson, Madison,
Culpeper, Rappahannock, Fauquier, Warren, and Shenandoah,
to the nearest line of railroad by the nearest practicable route,
and to acquire the right of way by gift, purchase, or lease;
and, if unable to acquire in that mode, then the land requi-
red for the right of way may be condemned in the manner
prescribed in the fifty-sixth chapter of the Code of eighteen
hundred and seventy-three, and under this act said company
shall have the right to transport passengers, freights, and
United States mails for tho convenience of the public, with
necessary powers for said purposes, and subject to the
restrictions imposed by law, and shall have power, under this
act, to borrow moncy, issue bonds, execute mortgages to
secure the same upon their property, in whole or in part, as
they may elect, to carry out and perfect their purposes: pro-
vided that this act shall be always subject to modification
and control of the general assembly of Virginia.
2. This act shall be in force from its passage.
