CxChap. 301.—An ACT to enable the James River and Kanawha com-
pany to contract with the Buchanan and Clifton Forge Railway com-
pany for the use of convict labor, granted to said first-named com-
pany by act approved December 12th, 1877.
Approved March 14, 1878.
1. Be it enacted by the general assembly of Virginia, That
it shall be lawful for the James river and Kanawha com-
pany to contract with the Buchanan and Clifton Forge rail-
way company for the use, by said company, of the convict
labor authorized by an act approved December twelfth, eigh-
teen hundred and seventy-seven, entitled an act to provide
for the use of convict labor on the James river and Kanawha
canal, to be used by the James river and Kanawha company
for the repairs of its works: provided that no such contract
shall take effect until the repairs of the canal from the freshet
of November, eighteen hundred and seventy-seven, are com-
pleted: and, provided further, that the time of using such
convict labor under said contract, shall not be extended
beyond the time limited in said act of December twelfth,
eighteen hundred and seventy-seven, viz: the first Wednes-
day in December, eighteen hundred and seventy-nine: and,
provided further, that any such contract or arrangement shall
be subject to the condition of the recall of the said convicts
by the governor in his discretion: provided, further, that in
the event of a foreclosure and sale of the James river and
Kanawha company, the governor shall recall all the convicta
then in the service either of the James river and Kanawha
company or of the Buchanan and Clifton Forge railway com-
pany: provided, further, that the number of able-bodied con-
victs turned over to the Buchanan and Clifton Forge railway
company under the provisions of this act, shall at no time
exceed two hundred and fifty.
2. This act shall be in force from its passage.
