Chap. 267.—An ACT appointing a board of directors for a certain sec-
tion of the Tazewell Courthouse and Fancy Gap turnpike road, in the
county of Wythe, and empowering said board to keep the same in
legal repair. )

1. Be it enacted by the general assembly, That John A.
Brown, Gabriel Felty, and William B. Foster, be and they
are hereby appointed a board of directors, for the control
and management ot that section of the Tazewell courthouse
and Fancy gap turnpike road, lying in Wythe county, com-
mencing at the line between Wythe and Bland counties and
running thence to the point where said turnpike first inter-
sects the corporate line of the town of Wytheville.
2. The said board shall have power to make contrecta for
keeping said section in legal repair, and may contract with
some proper person to erect a toll-gate at some suitable point
of said sections and empower him to demand and receive
thereat such rates of toll as may have been previously fixed
by the former board of directors of said turnpike. The said
tolls shall be applied to keeping said section in legal repair ;
and the excess of tolls, if any, shall be paid to the treasurer
of Wythe county, who shall apportion the same between the
commonwealth and said county equally: provided that such
contractor shall not receive a greater sum for keeping said
section in legal repair than the amount of tolls collected by
him. The said board may 1equire such contractor to give a
bond, with good security, in such penalty.as it may deem
reasonable, conditioned for the faithful performance of his
contract.
3. This act shall be in force from its passage.
