Chap. 256.—An ACT to amend and re-enact section seventeen of an
act entitled an act to provide for the organization and government
of the volunteer militia of the state, and to repeal existing laws con-
cerning the same, approved April 24, 1874.°
Approved March 14, 1878.
1. Be it enacted by the general assembly, That section
seventeen of an act entitled an act to. provide for the organ-
ization and government of the volunteer militia of the state,
and to repeal existing laws concerning the same, approved
April twenty-four, eighteen hundred and seventy-four, be
amended and re-enacted so as to read as follows:
§ 17. The staff of each regiment of infantry and cavalry
shall consist of one surgeon, with the rank of major; one
chaplain, with the rank of captain; one assistant surgeon,
with the rank of captain; one quartermaster, with the rank
of captain; one adjutant, with the rank of captain; and one
commissary of subsistence, with the rank of captain, who
shall be commissioned by the governor as the field and com-
pany officers of each regiment are commissioned, when a
certificate of appointment shall have been furnished by the
commandant of the regiment. Tach battalion of artillery
shall be composed of not less than four batteries, and com-
manded by a major of artillery, elected as prescribed i in sec-
tion sixteen, and commissioned by the governor upon certifi-
cate of election. The staff of the battalion of artillery shall
be appointed by the commandant of the battalion, and shall
consist of an adjutant, with the rank of captain of artillery ;
one surgeon, with the rank of major; one assistant surgeon,
with the rank of first lieutenant; one quartermaster, with
the rank of first lieutenant; one commissary of subsistence,
with the rank of first lieutenant; one ordnance officer, with
the rank of first lieutenant; and one chaplain, with the rank
of first lieutenant, who shall be so commissioned by the gov-
ernor; one sergeant-major, one commissary-sergeant, one
quartermaster-sergeant, and one ordnance sergeant, who
shali be each furnished a certificate of appointment by the
commandant of the battalion.
