Chap. 242.—An AQT to constitute the town of Warrenton and éur-
rounding territory a separate school district.
Approved March 14, 1878.
1. Be it enacted by the general assembly of Virginia, That
the town of Warrenton, in the county of Fauquier, if the
council of said town so elect, together with the territory to
be attached thereto, as hereinafter provided, shall constitute
a separate school district, to be governed by the provisions
of the general law on the subject, except in so far as they
may be modified by the provisions of this act.
2. There shall be attached to the town aforesaid for public
school purposes, so much of the surrounding country as is
embraced within the outer boundaries of the following tracts
of land, to-wit: those belonging to James Robinson, J. N.
Bethune, T. L. Moore, 8. P. Ludlow, A. D. Pollock, C. Bouck-
night, V. R. Morgan (now Payne’s); the lands formerly
belonging to George EH. Yeatman, deceased, Ann P. Brooke,
G. W. Grafiflin, Elias Edmunds, Enoch Jeffries, Mary F.
Sowers, and Mrs. H. W. Scott (dowress of R. E. Scott,
deceased), and any other tracts omitted to be mentioned,
necessary to constitute a continuous outer boundary of said
school district: provided, however, that at suzh time and
place within said district as the council of the town of War-
renton may designate, the question of agreeing to the
arrangement herein provided for, shall be submitted to the
duly qualified voters residing within the said district, but
without the corporate limits of said town, of which notice
shall be given by publication in some newspaper published
in said town, and such other mode as said council may
adopt, at least fifteen days before the time of voting on said
question, the mode and manner of conducting such voting to
be prescribed by said town council.
3. If a majority of the votes cast on said question shall be
against the arrangement herein provided tor, then and in
that event the provisions of this act shall be null and void.
But if such majority be in favor of the arrangement herein
provided for, then and in that event the said town of War-
renton, and the territory embraced within the foregoing
limits, shall constitute a separate school district to be known
as tho Warrenton school district, and the following provi-
sions shall be applicable thereto.
4. The council of said town of Warrenton shall have the
power to appoint three school trustees, from any part of such
consolidated district, to serve one, two, and three years,
respectively; and annually thereafter it shall appoint a school
trustee for said district, to serve for three years. The said
trustees shall have power to manage and regulate the schools,
to appoint teachers, fix their salaries, provide for all neces-
sary expenses, and perform all other duties, and be clothed
with all the powers now vested in the trustees of school?dis-
tricts. ~ were
5. Tho said trustees of said district shall have authority to
use and control for school purposes the public school prop-
erty in said separate school district.
6. As soon as the organization of the said separate district
shall be made, as aforesaid, it shall be lawful for the said
town of Warrenton to provide forthe support of the schools
therein, by levying a capitation tax of not less than fifty
cents, and a pro rata tax on real and personal property
within said district of not less than ten nor more than
twenty cents on every hundred dollars thereof, to be deter-
mined by said council. The said tax shall be collected by
such officer or officers as shall be appointed or directed by
said town council to collect the same, and be turned over by
him to the treasurer of said town, who shall keep a separate
account thereof, and disburse the same, according to the
order of said board of trustees; but said separate school
district shall be exempt from county school tax.
7. The said town council shall have power, from time to
time, to levy and collect from the property-bolders of said
town such additional tax as may be required, in the judg-
ment of said council, for school purposes in said district:
provided that the total tax so collected in any year, shall not
exceed three mills on the dollar in any one year.
8. As soon as the school board of said district shall be
appointed, the said board shall cause a census to be taken of
the school population of the district in legal form, and report
the same to the state superintendent, and the county super-
intendent; and thereafter all state school funds to which said
district shall be entitled, shall be apportioned accordingly,
and turned over in bulk to the treasurer of said town of
Warrenton, without commission.
9. This act shall be in force from its passage.
