Chap. 238.—An ACT to amend and re-enact section, 10, chapter 145,
Code of Virginia, 1873, in regard to actions for injuries.
Approved March 12, 1878.
1. Be it enacted by the general assembly of Virginia, That
section ten of chapter one hundred and forty-five, Code of
Virginia, eighteen hundred and seventy-three, be amended
and re-enacted so as to read as follows:
§ 10. Rights of action under sections seven and eight of
this chapter shall not determine, nor shall such actions, when
brought, abate by the death of the defendant or the dissolu-
tion of the corporation, when a corporation is defendant;
and where an action is brought by a party injured, for dam-
ages, caused by the wrongful act, neglect, or default of any
person or corporation, and the party injured dies pending
such action, and death is caused by such wrongful act, neg-
lect or default, said action shall not abate, but on the death
being suggested, as aforesaid, the same shall be revived in
the name of the personal representative of the decedent, and
shall be proceeded with according to sections seven, eight,
and nine of this chapter of the Code of Virginia: provided,
however, the declaration and other pleadings shall be
amended so as to conform to the change in the form of
action provided for by this section.
2. This act shall be in force from its passage.
