Chap. 233.—An ACT to amend and re-enact the 20th section, 79th
chapter, Code of 1873, in regard to duties of city councils to make
appropriations for school purposes.

1. Beit enacted by the general assembly of Virginia, That
the twentieth section of chapter seventy-nine of the Code of
Virginia, edition eighteen hundred and seventy-three, shall
be amended and re-enacted so as to read as follows:
§ 20. It shall be the duty of the city or town council, and
of every incorporated town of over five hundred inhabitants
which has been erected into a separate school district, to pro-
vide, in due time, and it shall have no power to withhold the
sum or sums reported by the city or town school boards, and
declared to be necessary for the proper maintenance and
growtb of the public schools of the city or town, except the
city of Richmond; the council of which said city shall have
the discretion of the board of county supervisors in smilar
cases: provided that the council shall not be required to
appropriate a sum greater than double the amount received
from school funds of the state during the same acholastic
year; but the council may, in its discretion, appropriate a
larger sum, but it shall not have power to impose a tax on
property for school purposes exceeding three mills on a
dollar in any one year. :
