Chap. 217.—An ACT for the relief of the sureties of S. F. G. Beale,
late treasurer of Fauquier county.

Whereas two judgments have been obtained in the circuit
court of the city of Richmond, on the tenth day of March,
eighteen hundred and seventy-five, by the commonwealth of
Virginia against S. F. G. Beale, late treasurer of Fauquier
county, and William Beale, John H. Rixy, Charles H. Gor-
don, and James W. James, his sureties—one for the sum of
eleven thousand one hundred and ninety-four dollars and
seventy-three cents, with interest on eleven thousand and
twenty-one dollars and thirty-seven cents, part thereof from
June twenty-fifth, cighteen hundred and seventy-four; and
on one hundred and seventy-three dollars and eighty-six
cents, residue thereof from September first, eighteen hun-
dred and seventy-four, until paid, and damages according to
law; and the other for three thousand nine hundred and
eighteen dollars and seventy-eight cents, with interest thereon
to be computed at twelve per centum per annum from the
twentieth day of May, eighteen hundred and seventy-three,
until paid, and damages according to law—which judgments
are liable to credits amounting to five thousand one hundred
and seventy dollars and one cent; and whereas it is made to
appear tbat it would be just and equitable, under the circum-
stances of the case, that relief should be granted, as herein-
after provided:
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts is hereby authorized and
directed to accept from the said sureties, or any of them,
coupon bonds of the state of Virginia, with coupons receiva-
ble in payment of taxes and public dues to the amount of
the principal amount of said judgments, and legal interest
thereon, and costs and expenses of collection, the damages
having been heretofore released by act of the general assem.-
bly in full, But nothing herein contained shall be construed
as affecting the liability “ot said 8. FG. Beale, late treasurer,
under the said judyments, except that said bonds so received
shall be credited at their market value at the time of deliv-
ery, and the said sureties shall be entitled to contribution as
amongst themselves, according to the amount paid by them:
provided, however that such payment must be made within
twelve months from the passage of this act.
2. This act shall be in force from its passage.
