Chap. 208.—An ACT to incorporate the Essex cemetery company.
Approved March 12, 1878.
1. Be it enacted by the general assembly of Virginia, That
Doctor William G. Jeffries, W. W. Stone, William Campbell,
A. W. Broaddus, John M. Owen, George L. Mienley, James
McDonald, G. W. Mitchell, T. C. Walker, R. T. Cauthorn,
Robert L. Ware, Thomas Craxton, H. W. Daingerfield, T. P.
Baughan, and John M. Brockenbrough, and such other per-
sovs as they shall associate with them, and their successors,
shall be and are hereby made and constituted a body politic
and corporate, under the name of The Essex Cemetery com-
pany, subject to the provisions of the fifty-sixth and fifty-
seventh chapters of the Code of Virginia, edition of eighteen
hundred and seventy-three, so far as the same may be appli-
cable and necessary for cemetery purposes; also, the act
approved February tenth, eighteen hundred and seventy-
six: provided that at no time shall the real estate held by
the said company exceed twenty acres. The officers of the
company shall be a president and five directors, who shall
be elected once in every two years by the company, and such
other officers as the board may deem necessary and proper,
and whose duties shall, from time to time, be prescribed by
the by-laws, rules, and regulations of the company; the first
election to be held on the fifteenth day of April, eighteen
hundred and seventy eight. No interest of a corporator in
the property of the said company shall be subject in any
way to the payment of debts, pass by insolvency or into the
hands of personal representatives, or be liable for taxes of
any description, but the rights and interest shall remain in
the families of each, according to the course of descent: pro-
vided that no money derived from the sale of lots in this
cemetery shall be appropriated to private use or for any
other than the benefit and improvement of the said cemetery.
No streets, lanes, roads, or alleys, shall at any time be estab-
lished or made over the land of said company, or any part
thereof, without the consent of said company; nor shall the
same be condemned, or taken in any manner, for any public
use, without such consent. The grounds and improvements
thereon, and all other property and things connected there-
with, belonging to the company hereby incorporated, shall,
for all police purposes, be under the protection of, and subject
to the ordinances of the town of Tappahannock; and the
mayor of said town shall have jurisdiction concurrent with
the justices and other officers of Essex county, of all offences
committed upon and within said grounds, in the same man.

The said company shall not own any land at a greater
distance than one mile from the corporate limits of the town
of Tappahannock, Exsex county.
3. This act shall be in force from its passage.
