Chap. 119.—An ACT to empower the county court of Warren county
to authorize Carson and Sons to establish a ferry across the north
branch of the Shenandoah river, and also at the junction of the north
and south branches of the said river, in said county.

Whereas the county court of Warren county has not the
authority, under section twelve, chapter sixty-four, of the
Code of Virginia, edition of eighteen hundred and seventy-
three, to authorize Carson and Sons to establish a ferry
across the north branch of the Shenandoah river, and also a
ferry at the junction of the north and south branches of the
Shenandoah river, in said county; therefore, to empower
said county court to establish said ferry or ferries,
1. Be it enacted by the general assembly, That the county
court of Warren éounty is hereby authorized and empowered
to permit Carson and Sons, of said county, to establish a
ferry across the north branch of the Shenandoah river, from
some point on their lands, at or near their lime-kilns, to some
convenient point on the land of the Riverton mills company,
limited, on the opposite shore of the said river, with the
rigbt of way through the land of the said Riverton mills
company, limited, to the depot, at Riverton, of. the Washing-
ton City, Virginia Midland and Great Southern railroad com-
pany, and also to allow said Carson and Sons to establish a
ferry at the junction of the north and south branches of the
Shenandoah river, across said river, from some point on the
lands of said Carson and Sons to some convenient point on
the land of the Front Royal lime and lumber company, on
the opposite shore, with the right of way through the land
of the said Front Royal lime and lumber company, to the
lime-kiln switch, on the Shenandoah Valley railroad, where
the same crosses the track of the Washington City, Virginia
Midland and Great Southern railroad. .
2. The publication of the notice, for four successive weeks,
in some newspaper published in said county of Warren, of
the application of Carson and Sons to said court for the
establishment of the ferry or ferries mentioned in the pre-
ceding section of this act, shall be in lieu and in full of the
notice required to be given by section twelve, chapter sixty-
four, Code of eighteen hundred and seventy-three.
3.-Upon the application to the said county court by said
Carson and Sons, their agent, or attorney, for the establishment
of the ferry or ferries at the point or points mentioned and
described in section one of this act, the said county court
shal] appoint three or more commissioners to view the places
for said ferry or ferries, who shall examine the same and re-
port what lands are necessary to be taken for the uses of
said Carson and Sons in the successful operation of said ferry
or ferries, conforming as near as practicable to the provi-
sions of chapter fifty-two, Code of eighteen hundred and
seventy-three, applicable thereto.
4. Upon such report, and after the land-owners have been
summoned, in accordance with section twenty-five, chapter
fifty-two, of said Code, said ferry or ferries, and roadway or
road ways, shall be established by said county court, allow-
ing such compensation for land damages as is just and reason-
able, which shall be paid by said Carson and Sons, together
with all costs attending the application for said ferry or fer-
ries.
5. Unless the county court of said county shall, after due
proceedings had in said court, fix other rates of ferriage, the
rates at such ferry er ferries shall be as follows, to-wit: For
every person, five cents; for every horse, mule, jack, and
work-ox, five cents; for each cow, calf, and steer, four cents;
for every head of sheep, and of swine, two cents;.and for
every cart, wagon, carriage, or other vehicle, five cents for
each animal attached to the same, and five cents for each
wheel.
6. The ferry or ferries hereby authorized to be established,
shall be subject to all of the rules, regulations, conditions,
and penalties prescribed by general statutes, now in force or
hereafter to be enacted, governing ferries established under
the provisions of chapter sixty-four of the Code of eigbteen
hundred and seventy-three; and the proprietors of each ferry
or ferrics, shall be entitled to all of the rights, privileges, and
remedies, given to them as such, under s: aid statutes, and the
provisions of said chapter of said Code.
7 The establishment of said ferries being necessary for the
successful operation of the extensive lime works of Carson
and Sons, in said county, and of great convenience to the
public, the said Garson and Sons shall have the right of estab-
lishing, in the manner prescribed in this act, anid ferry or
ferrics, at such times as they deem best.
8. This act shall be ir force from its passage.
