Chap. 267.—An ACT to quiet titles of purchasers of delinquent lands
sold under the act of the 2d April, 1873, and to repeal so much of the
act of the 28th April, 1874, as provides additional sections 38 and 39
for chapter 58, Code 1873.

Whereas in consequence of the joint resolution approved
January fourteenth, eighteen hnndred and seventy-four, sus-
pending the sales of delinquent lands, and from other causes,
doubts and difficulties respecting the regularity of the sales
of delinquent lands made under the act of April second,
cighteen hundred and seventy-three, have arisen, seriously
affecting the titles of the purchasers at said sales; and whereas
is is right and proper that they should have the means of
perfecting their titles; now therefore,
1. Be it enacted by the general assembly of Virginia, That
the auditor is hereby required to make out and forward to
the respective county treasurers forthwith, lists of all taxes
for county purposes with which the lands sold under the act
approved the second day of April, eighteen hundred and
seventy-three, to other persons than the commonwealth, were
chargeable under said act, providing in the margin of said
lists a column for the insertion of the names of the purcha-
sers of the parecls of land embraced therein, and appending
thereto a blank form of notice from the treasurer, of the
time given for the redemption of said lands, and tho manner
in which the purchaser thereof may, if said land be not re-
deemed, perfect his title to the same, as hereinafter provided.
He shall forward to the treasurer of each county in which
Jands were so sold, four copies of said lists for such county.
The treasurer sball fill up the blanks therein with the names
of the respective purchasers; shall keep one list in his office,
and shall post the other three—one on the front door of the
court-house and the others in two public places in the county,
by or before the first day of July, eighteen hundred and
seventy-seven: provided that in any county from which no
return has been made to the auditor of delinquent county
levies, or of sales made by county treasurers under the act
of April second, cighteon hnndred and seventy-three, lists of
such delinquent levies, and of such sales of delinquent lands,
shall be made out for: the county treasurer by the clerk of
said county. .
2. The owner of any land so sold, his heirs or assigns, or
any person acting for him, or any person having a right to
charge such land for a debt, may, at any time before the first
day of July, eighteen hundred and seventy-eight, redeem
the same by the payment to the purchaser thereof, his heirs
or assigns, or to the clerk of the county, in the manner pro-
vided for in the sixteenth and seventeenth sectious of chap-
ter thirty-cight of the Code of Virginia of cightecn hundred
and seventy-three, the sums therein required, together with
such additional expenses as said purchaser shall bave in-
curred under the eighteenth, nineteenth, and twentieth sec-
tions of said chapter, and by the further payment to the
couoty treasurer of all such taxes for county purposes as
said land was properly chargeable with at the passage of the
act of April second, eighteen hundred and seventy-three,
and such proportion of the charges and expenses incurred
under this act as shall be chargeable to such parcel of land.
3. If said land shall not be so redeemed before the first day
of July, eighteen hundred and seventy-eight, the purchaser
thereof, his heirs or assigns, may thereupon proceed to per-
fect bis title by the payment to the county treasurer of the
taxes for county purposes, charges, and expenses, specified in
the preceding section; and upon the payment thereof at any
time before the first day of January, eighteen hundred and
seventy-nine, the title of such purchaser shall be cured of all
defects and irregularities arising from the non-compliance
with the law in conducting or making return of said sale;
and all the right, title and interest, vested in the party as-
sessed with the taxes on said land, on the day of said sale,
shall be thereafter fully and completely vested in the pur-
chaser thereof, his heirs or assigns; saving, however, to in-
fante, and all other persons under disabilities, all rights and
remedies now provided by law.
4, The same compensation shall be allowed the treasurers,
under this act, as for like services in proceeding to sell delin-
quent lands under chapter thirty-eight of the Code of Vir-
ginia of eighteen hundred and seventy-three.
9. Should said lands not be redeemed, and should the pur-
chasers thereof not pay the county taxes for which raid
lauds were delinquent as aforesaid, by or before tho first da
of January, eighteen hundred and seventy-nine, the boards
of supervisors shall have the same right to redeem the same
as is now provided by law for the owner or person having the
right to charge said land for a debt; and the said boards of
supervisors, upon the redemption of said lands, may, through
the treasurers of their respective counties, sell the same for
delinquent county levies and the cost of redemption, in con-
formity, as near as may be, with the laws regulating the sales
of delinquent lands by the treasurers for state taxes.
6. So much of the act approved the twenty-eighth day of
April, eighteen hundred and seventy-four, as provides addi-
tional sections thirty-cight and thirty-nine, for the thirty-
eighth chapter of the Code of Virginia of eighteen hundred
and seventy-three, is hereby repealed.
