Chap. 246.—An ACT to allow commutation for soldiers maimed in
war in lieu of artificial limbs and eyes provided by law.

Whereas the sum of money heretofore appropriated for
artificial limbs, and commutation therefor, has been exhauated.
and many soldiers entitled to limbs or commutation have not
received either; therefore,
1. Be it enacted by the general assembly, That the sum
of ten thousand dollars be, and the same is hereby appro-
priated out of the public treasury, to be paid to such soldiers,
sailors, marines, or employees who were detailed soldiers, as
apply and are entitled to the same in accordance with the
provisions of section seventeen of chapter seventy-six of the
Code of eighteen hundred and seventy-three: provided that
soldiers and employees who have lost an eye, shall be entitled
to the same provisions as those who have lost limbs: and
provided further, that such applicants have not received
imbs or eyes, or commutation, under any of the acts here-
tofore passed for that purpose.
2. Any soldier or employee disabled in such a manner as
to prevent the use of his limbs or one eye in manual labor,
induced by wounds or surgical operations rendered necessary
thereby, who shall furnish the certificate required by said
section, shall be entitled to commutation, at the rate of sixty
do}lars each, in lieu of the limb or eye provided by law.
3. Hereafter the testimony upon which the certificate of
the county judge is issued shall accompany the certificate re-
quired by law. Both of which shall be transmitted by the
clerk of the county court to the auditor of public accounts.
And it shall be the duty of the auditor to examine sach tes-
timony, and‘unless in his judgment the testimony accom-
panying the certificate of the judge shall make out a case of
disability, as required by law, he shall not issue his warrant
for the commutation provided by this act.
4. The auditor of public accounts is hereby authorized to
issue his warrants on the treasury to pay the claims properly
allowed under this act, and the same shall be paid out of the
money therein not otherwise appropriated : provided that the
sum hereby appropriated shall be apportioned between the
different congressional districts (and ratably between the
counties thereof) of the state according to the number of
persons therein respectively entitled to such commutation,
who shall file their application before the first day of July
next.
5. This act shall be in force from its passage.
