Chap. 233.—An ACT to provide for keeping the paupers in the countie:
of Scott, Lee and Grayeon.

1. Be it enacted by the general assembly, That it shall be
lawful for the board of supervisors for the counties of Scott,
Lee and Grayson, or either of them, on the first day of Sep-
tember, eighteen hundred and seventy-seven, and every two
years thereafter, to advertise for and receive sealed proposals
for clothing and Supporting the paupers at the county poor
farm in the said counties, for the period of two years, from
the first day of January following; and said proposals shall
specify the sum per head per annum, and for the same rate
for any period of a less term, including the services of super-
intendant of the poor, for the period of two years, payable
annually, in addition to the rents and profits of the poor
farm, which the bidder sball have should the contract be
awarded to him; said proposals shall also contain a guarantee
at the foot of the same, signed by at least two responsible
parties, guaranteeing that the bidder will faithfully comply
with the terms of his bid, and execute such bond as the su-
pervisors of the said counties, or either of them, shall deter-
mine, in the event bis bid isaccepted and the contract awarded,
thereon. And upon the failure of any bidder to comply with
the terms of his bid within thirty days from the time of its
acceptance by the said supervisors, they may, by motion
before the county court of said county, after ten days notice
of the same, recover judgment for such damages as may be
awarded on account of the difference between the bid so ac-
cepted and the next lowest responsible bidder, and such addi-
tional costs as may be ificurred by the board of supervisors,
and the legal costs of said motion.
2. The board of supervisors, at their first meeting afler the
said sealed proposals shall have been received, shall open and
consider the same, and shall award the contract to the lowest
responsible bidder, who shall, within thirty days, execute a
bond, with sufficient sureties, before the board of supervisors,
in such sum as they may require, for the faithful performance
of the duties herein required. Upon the failurcof any bidder
to comply with the contract, the supervisors may proceed to
again re-let the same or accept the next lowest responsible
bidder, whichever in their discretion is deemed most advisable.
4. The said bidder so accepted, shall be designated by the
name of the superintendent of the poor, and shall be ap-
pointed by the judge of the county court, to hold office for
the term of two years, and shall be subject to all the pro-
visions of chapter fifty-one, Code of eighteen hundred and
seventy-three, and acts amendatory thereof, applicable to
superintendents of the poor in so far as the same is not in-
consistent with the provisions of this act. But the provi-
sions of section three of an act entitled an act to provide for
the electioh and qualification of county officers, app rowae
March eighth, eighteen hundred and seventy-five, shall not
be applicable to the said counties of Scott, Lee and Grayson,
so far as the same applies to superintendents of the poor.
5. The clerk of the county court of the said county shall
prepare proper forms for the proposals hereinbefore named,
distribute and advertise the same under the direction of the
board of supervisors, and for any extra services performed
under this act, shall receive such compensation as the said
supervisors may deem just and proper.
6. This act shall be in force from its passage.
