Chap. 176.—An ACT to authorize Elzey Evans, of Accomack county,
to erect a wharf on his land lying on Pungoteague creek in said
county.

Whereas it is represented to the general assembly, that
Elzey Evans, of the county of Accomack, has erected a wharf
on his land, lying on Pungoteague creck, in the county of
Accomack; therefore,
1. Be it enacted by the general assembly, That the erec-
tion of the said wharf is hereby declared legal, and that the
said Elzey Evans, his heirs and. assigns, shall have the right
to charge and recover such fees as a compensation for the use
of said wharf as may be agreed upon by and between the
parties, or as have heretofore been paid for the same or similar
use: provided that such wharf shall not obstruct or impair
the free navigation of said creek; and provided also that this
act shall at all times be-under the control of the general as-
sembly, and may be amended or repealed as it may deem
proper. ;
2. This act shall be in force from its passage.
