Chap. 157.—An ACT incorporating the town of Burkeville, in the
county of Nottoway.
approved March 17, 1877.
1. Be it enacted by the general assembly, That the town
of Burkeville, in the county of Nottoway, and state of Vir-
ginia, as the same is now laid off into lots, streets, and alleys,
and as may hereafter be laid off into lots, streets, and alleys,
shall be, and the same is hereby made a town corporate, by
the name of Burkeville, and shall have and exercise all the
rights, powers, and privileges, and shall be subject to all the
duties, liabilities, and restrictions now imposed by law for
the government of towns of less than five thousand inhabi-
tants, or by any laws which may hereafter be enacted for
the government of said town.
2. The area thus incorporated by this charter, shall be one
square mile, lying equally on either side of. Agnew street,
two sides of the square parallel with said street, and the in-
tersection of Agnew street with the main track of the Atlan-
tic, Mississippi and Ohio railroad, shall be its geometrical
center.
3. The officers of said town shall consist of eight trustees,
who shall be the town council, a majority of whom shall con-
stitute a quorum for the transaction of business; and the fol-
lowing-named persons shall constitute the board of trustees,
to-wit: Joseph E. Leath, William H. Hallowell, J. R. Tun-
stall, W. A. Cauthorn, H. F. Bardwell, James A. Agnew, H.
H. W. Crittenden, and James E. Grigg, who shall hold their
offices as follows, to-wit: the first named two for the term of
one year from the first day of March, eighteen hundred and
seventy-seven; the next named two for the term of two
years from the first day of March, eighteen hundred and
seventy-seven; the next named two, three years from the
first day of March, eighteen hundred and seventy-seven; and
the last named two, four years from the first day of March,
eighteen hundred and seventy-seven.
4, An election shall be held the first Tuesday in February,
eighteen hundred and seventy-eight, and annually thereafter,
for two members of the council, who shall hold their offices
four years. The said trustees, so elected and qualified, shall
enter upon the discharge of their duties on the first day of
March succeeding their election. The said board shall have
authority to appoint a town sergeant, who shall be ex officio
collector of corporation taxes and all moneys due the corpo-
ration. Said town sergeant shall perform all duties within
the limits of said corporation which a constable may do by
the laws of this state; and for such services shall receive like
pay; and for services rendered said corporation, shall receive
such pay as may be fixed by the town-council.
5. The board of trustees shall elect from their body, a
president, who shall preside at their meetings. He shall be
mayor of the town, and hold his office one year.
6. The board of trustees shall have authority to levy such
taxes as may be necessary for the said corporation: provided
that the same shall not be more than fifteen cents on the one
hundred dollars’ worth of property within the limits of said
town; and may impose taxes on all vocations, professions, or
business as are or may be subject to taxation by the laws of
this state: provided that such taxes do not exceed one-fourth
of such tax as is imposed by state laws, except that in no
case shall a license tax be less than five dollars; and the said
trustees shall have authority to impose a tax on dogs, so that
said tax docs not exceed one dollar and fifty cents per head.
7. That the citizens of the said town of Burkeville shall
be exempt from working on any road, and from the payment
of any road tax: provided the said town shall, at its own
expense, keep its streets. in order, and provide for its poor;
and the said town council shall have the power to cause all
its male citizens to work on the streets, roads, and alleys
within the corporate limits of said town, for the same num-
ber of days, and subject to the same conditions, as are now
provided for working roads in the general road laws of the
state,
8. That the trustees shall bave authority annually to ap-
point fhree appraisers, who shall be freeholders and residents
of said town, who sball value the real estate of said town;
and said valuation shall be the basis of taxation for corpora-
tion purposes.
9. This act shall be in force from its passage.
