Chap. 152.—An ACT for the relief of James B. Eastham, late collec-
tor of Stonewall township, Rockingham county.
Approved March 13, 1877.
Whereas James B. Eastham, late collector of Stonewall
township, Rockingham county, state of Virginia, on account
of the pecuniary embarrassment of the people of said town-
ship, caused in part by the great flood of eighteen hundred
and seventy, has fallen into arrears in collecting and paying
the taxes of said township; and whereas judgment has been
obtained against the said James B. Eastham and his sureties
for the sum of one thousand three hundred and ninety-one
dollars and two cents, with interest and costs; and whereas
the said James B. Eastham still bas in his possession tax bills
sumcient to pay a large proportion of said judgment; there-
ore, ,
1. Be it enacted by the general assembly, That the audi-
tor of public accounts be, and he is hereby authorized and
instructed to extend the time for enforcing the said judgment
and collecting the balance due thereon for twelve months
from the date of the passage of this act: provided however,
that should the said J et Eastham pay into the treasury
of the state, within twelve months, one-half of the amount
of said judgment and costs, then the auditor of public ac-
‘counts is hereby authorized and instructed to extend to him
the further time of twelve months in which to pay the re-
maining half.
2. That authority is hereby given to the said James B..
Eastham, collector as aforesaid, to collect the amounts due
upon any unpaid tax tickets in his hands, and he shall have
the same power of distress as treasurers and collectors had
at the time such tax tickets were placed in his hands: pro-
vided however, that he shall not by this act be authorized
to collect, by distress or levy, any such tax tickets of longer
standing than five years: and provided that before the said
collector shall have the benefit of this act, the consent of his
sureties on his official bond shall be obtained to such exten-
sion: and provided, also, that he shall execute a new bond,
conditioned according to law, with securities approved by
the judge of the county court, ina penalty of double the
amount of the judgment, costs, and damages; and in the
event said bond is not executed, he sball turn over the tax
tickets in his hands to the treasurer of the county, who shall
collect and account for the same to the commonwealth as
now required by law; and as soon as said tax tickets, or any
portion of them, are collected, the said collector shall have
credit for the amount so collected, on the judgment against
him; and the treasurer shall have the same power to dis-
train and sell as he now has in the collection of other taxes.
3. This act shall be in force from its passage.
