Chap. 63.—An ACT to amend and re-enact section sixteen, chapter
one hundred and twenty-eight, Code of eighteen hundred and seventy-
three, as amended by an act approved April twenty-eighth, eighteen
hundred and seventy-four, in reference to Commissioners in Chancery.

1. Be it enacted by the general assembly, That the six-
teenth section of chapter one hundred and twenty-eight,
Code of: eighteen hundred and seventy-three, as amended by
an act approved April twenty-eighth, eighteen hundred and
seventy-four, be amended and re-enacted so as to read as
follows:

§ 16. Whenever any court shall deem it expedient, it may
authorize and require one or more of its other commissioners
in chancery to settle accounts of fiduciaries; whereupon such
commissioner may proceed to settle all such accounts of fidu-
ciaries as any fiduciary may lay before them, or any party
interested may require them to settle.. And in the settle-
ment of any particular estate any court may, on motion of
the fiduciary having charge of said estate, or of any one in-
terested therein, order the account to be stated and settled
by any one of its commissioners in chancery; and any com-
missioner other than the commissioner of accounts, who
shall make settlement, shall within thirty days, report the
date thereof to the commissioner of accounts, who shall en-
ter the same in his record book. AIl commissioners shall,
on application, execute and deliver to such fiduciary or other
person whose account is being settled, a receipt for all
vouchers filed before him, stating therein each particular
‘voucher, which receipt, if said voucher or vouchers after-
wards be lost, shall be prima. facie evidence in any suit
against said fiduciary that he delivered to the commissioner
the voucher therein described.
