Chap. 46.—An ACT to allow Commutation for Soldiers Maimed in
War, in lieu of Artificial Limbs heretofore provided.
Approved February 10, 1876.
Whereas, the sum of money heretofore appropriated for
artificial limbs, and commutation therefor, has been ex-
hausted, and many soldiers entitled to limbs or commutation
have not received either: therefore,
1. Be it enacted by the general assembly, That the sum of
six thousand dollars be and the same is hereby appropriated
out of the public treasury, to be paid to such soldiers or em-
ployees as apply and are entitled to the same in accordance
with the provisions of section seventeen of chapter seventy-
six of the Code of eighteen hundred and seventy-three: pro-
vided such applicants have not received limbs or commu-
tation under any of the acts heretofore passed for that
purpose. ,
2. Any soldier or employee disabled in such a manner as
to prevent the use cf his limbs in manual labor, induced by
wounds or surgical operations rendered necessary thereby,
who shall-furnish the certificate required by said section,
shall be entitled to commutation at the rate of sixty dollars
each, in lieu of the limb heretofore provided by law.
3. Hereafter the testimony upon which the certificate of
the county or corporation judge is issued, shall accompany
the certificate required by law; both of which shall be trans-
mitted by the clerk of the county or corporation court to
the auditor of public accounts. And it shall be the duty of
the auditor to examine such testimony, and gunless in*his
judgment the testimony accompanying the tertificate of the
judge shall make out a case of disability, as required by law,
he shall not issue his warrant for the commutation provided
by this act.
4, The auditor of public accounts is hereby authorized to
issue his warrants on the treasury to pay the claims pro-
perly allowed under this act, and the same shall be paid out
of any money therein not otherwise appropriated.
5. It is provided that two thousand dollars of the sum
hereby appropriated, shall not be paid out of the treasury
within the period of sixty days after the passage of this act
to any person who may claim its benefits, other than one of
those who has heretofore filed his claim for a similar benefit,
and who shall have within that period, established his right
to share in the appropriation hereby made in accordance
with the terms of this act.
6. This act shall be in force from its passage.
