Chap. 41.—An act for the Relief of the Sureties of Samuel J. Spindle,
late Treasurer of Rappahannock County.
Approved February 7, 1876. ,
_ 1. Be it enacted by the general assembly, That authority
‘be given to the auditor of public accounts to collect the re-
,mainder of a judgment in equal instalments, of six, twelve,
‘and eighteen months from the passage of this act, against
Brewington J. Wood, Alexander F. Menefee, John A. Comp-
ton, James M. Wood, Albert Woodard, Walter B. Hackley,
and John M. Teasell, sureties of Samuel J. Spindle, late
treasurer of Rappahannock county: provided, he shalt be
satisfied that the same, in the meantime, is sufficiently se-
cured by the judgment lien; but nothing herein contained
shall be construed.to prohibit the auditor from collecting the
debt whenever he may think proper to do so. But if the
indulgence is given, it must be with the written assent of
the securities.
2. The auditor of public accounts is authorized and hereby
required, upon a settlement of the aforesaid judgment, to
receive from said sureties, in discharge of said judgment
against said sureties, payment of the principal, legal interest,
costs, and expenses of collection, abating therefrom the dam-
ages which have been awarded for said default: provided,
that nothing herein contained shall be construed as relieving
said Samuel J. Spindle from any liability to the common-
wealth.

Chap.42.—An ACT to incorporate the Virginia and North Carolina
Railroad Company.
Approved February 7, 1876.
1. Be it enacted by the general assembly, That it shall ‘be
lawful to open books of subscription in the town of Hillsville,
under the direction of Garland Hale, Robert H. Anderson,
James Johnson, and James McMurrain, or any three of them;
at Max Meadows, under the direction of Cloyd McGavock,
John Sayers and John H. Fulton; at Wythe lead mines, under
the direction of John Simmerman, John Raper and Dr. Rich-
ard Sanders; at the Grayson springs, under the direction of
Thomas Nuckolls, A.S. Blair and Alexander Dixon; at Gray-
son old courthouse, under the direction of Charles A. Weath-
ers, William P. Waugh, John Austin and Garland Anderson ;
at Independence, under the direction of Alexander M. Davis,
John W. Vaughn, Marville Thomas and Joshua Cox; at
Bridle Creek, under the direction of Isom Cox, Jacob Grub,
Isaac Parsons and William Bryant; at the Mouth of Wilson
creek, under the direction of Fields Young, Jeremiah HE.
Lovelace, Wilbourn Ross and William C. Parks; any two or
more of whom may act, for the purpose of receiving sub-
scriptions to an amount not exceeding six hundred thousand
dollars, in shares of fifty dollars each, to constitute a joint
capital stock for constructing a railroad from the Atlantic,
Mississippi and Ohio railroad, at or near Max Meadows, to
some point on the North Carolina line east of the Mouth of
Wilson creek, in the county of Grayson.
2. Be it further enacted, That when over fifty thousand
dollars of the amount aforesaid shall have been subscribed,
the subscribers, their executors, administrators and assigns,
shall be and they are hereby declared and constituted a body
politic and corporate, under the name and style of the Vir-
ginia and North Carolina Railroad Company, and shall be
entitled to all the privileges conferred, and subject to all the
restrictions imposed by the Code of Virginia, edition eigh-
teen hundred and seventy-three, and acts amendatory
thereof, so far as the same are applicable and not inconsistent
with this act.
3. It shall be lawful to receive subscriptions for the con-
struction of this road in money, labor, land or material, such
as timber, stone, lumber or other supplies, required in the
construction of railroads.
4. It shall be lawful to receive subscriptions to the stock
of this company from any connecting railroad company, or
from any mining or manufacturing company, or from any
county or counties in Virginia that may be interested in its
construction.
5. It shall be lawful for said company to lease its road, or
any part thereof, to any railroad company chartered by the
commonwealth.
