Chap. 39.—An ACT to amend and re-enact section sevent -three,
chapter sixty-one of Code of eighteen hundred and seventy-three, in
relation to Abandoned Turnpikes. :
Approved February 4, 1876.
1. Beit enacted by the general assembly of Virginia, That
section seventy-three, chapter sixty-one of the Code of eigh-
teen hundred and seventy-three, be amended and re-enacted
so as to read as follows:
§73. Whenever any turnpike company shall have aban-
doned its road, or any part thereof, the county court of any
county in which such road or any part of it thus abandoned
lies, may take charge of said road, or any’part thereof, and
appoint surveyors and assign hands to work them according
to the provisions of an act of the general assembly, approved
March twentieth, eighteen hundred and seventy-tive, entitled
an act to provide for working and keeping in order the roads
of the commonwealth; provided, however, this act shall not
apply to any turnpike which may have heretofore been
taken possession of by the county court of any county under
the laws in force prior to the passage of this act.
2. This act shall be in force from its passage.
