Chap. 35.—An ACT to amend and re-enact section eight of chapter one
hundred and eighty-seven of the Code of eighteen hundred and seven-
ty-three, in relation to Procuring Abortions and Miscarriages.

1. Be it enacted by the general assembly, That section
eight of chapter one hundred and eighty-seven of the Code
of eighteen hundred and seventy-three, be amended and re-
enacted so as to read as follows:
§8. Any person who shall administer to, or cause to be
taken by a woman, any drug or other thing, or use any means.
with intent to destroy her unborn child, or to produce abor-
tion or miscarriage, and shall thereby destroy such child, or .
produce such abortion or miscarriage, shall be confined in
the penitentiary not less than three nor more than five:
years. No person, by reason of any act mentioned in the
foregoing part of this section, shall be punishable where such.
act is done in good faith, with the intention of saving the
life of such woman or child. And any person who shall, by
publication, lecture, advertisement, or by the sale or circula-
tion of any publication, or in any other manner, encourage
or prompt the procuring of abortion or-miscarriage, shall be
deemed guilty of a misdemeanor, and shall, upon conviction,
be fined not less than one hundred nor more than five hun-
dred dollars, and be confined in jail not less than one nor
more than twelve months for each offence.
2. This act shall be in force from its passage.
