Chap. 116.—An ACT to amend an act entitled an Act to Provide for
the Organization and Government of the Volunteer Militia of the
State, and to Repeal Existing Laws Concerning the Same, approved
April the twenty-fourth, eighteen hundred and seventy-four, by
adding two additional sections.
Approved March 15, 1876,
1. Be it enacted by the general assembly, That an act
entitled an act to provide for the organization and govern-
ment of the volunteer militia of the state, and to repeal ex-
isting Jaws concerning the same, approved April the twenty-
fourth, eighteen hundred and seventy-four, be amended by
adding the two following sections:
§ 54. Every regiment formed in accordance with section
fifteen of this act, may make by-laws and regulations for its
own government, which, unless contrary to the laws of the
state or of the United States, shail be obligatory upon its
members; and whenever any fine or penalty for neglect of
duty or other cause shall be imposed by virtue of such by-
laws, the same may be collected as prescribed in section
thirty of this act. | ,
§55. Every volunteer company may make by-laws and
regulations for its own government, which, unless contrary
to the laws of this state or of the United States, or to the
by-laws of the regiment into which it is assigned, shall be
obligatory upon its members, and whenever any fine or pen-
alty for absence from drill, neglect of duty, or other cause,
shall be imposed by virtue of such by-laws, the same may
be collected as prescribed in section thirty of this act. Every
company shall have a court-martial, to be appointed by the
commandant of the regiment, which shall consist of one
commissioned officer as president, one non-commissioned
officer as recorder, and three privates. The court shall try
all offences arising from violation of company by-laws and
impose the fines in this act and in these by-laws provided.
This court in its form of procedure shall be regulated by the
regimental by-laws.
2. This act shall be in force from its passage.
