Chap. 115.—An ACT to amend and re-enact section ten of an act to
provide for the Election and Qualification of County Officers, approved
March eighth, eighteen hundred and seventy-five.
Approved March 15, 1876.
1. Be it enacted by the general assembly, That section ten
of an act to provide for the election and qualification of
county officers, approved March efghth, eighteen hundred
and seventy-five, be amended and re-enacted to read as
follows: :
- §10. The county and corporation courts shall have power
to remove from office all county, city, town, and district
officers elected or appointed in their counties, corporations,
and districts, respectively, for malfeasance, misfeasauce, in-
competency, or gross neglect of official duty; such removal
to be deemed a vacation of the office: provided, that the cir-
cuit courts shall have power, for the same causes, to remove
the clerks of their courts, respectively, and with like effect.
All proceedings under this section shall be by order of, or on
motion before the proper court, upon reasonable notice to
the party to be affected thereby; and the accused shall have
the right to demand a trial by jury.
2. This act shall be in force from its passage.
