Chap. 105.—An ACT to confer upon the Worcester Railroad Company,
incorporated by the General Assembly of Maryland, certain Corporate
Privileges and Immunities to be exercised within the Limits of the
State of Virginia.

Whereas, anZact was passed March eighteenth in the year
eighteen hundred sixty-seven, by the general assembly of
Maryland, entitled an act to revive and extend an act to
incorporate the Worcester railroad company, passed at the
January session, eighteen hundred and fifty-three, with
amendments, and an amendment thereto was passed by the
said general assembly, on the nineteenth day of February, in
the year eighteen hundred and seventy, entitled an act to
amend an act passed March eighteenth eighteen hundred
and sixty-seven, entitled an act to revive and extend an act
to incorporate the Worcester railroad company passed at the
January session, eighteen hundred and fifty-three, with
amendments; and whereas the said Worcester railroad com-
pany, under and by virtue of the said acts, is desirous of
extending its railroad within the limits of the State of Vir-
ginia; therefore,
1. Be it enacted by the general assembly, That the same
rights and privileges shall be and are hereby granted to the
aforesaid company within the territory of Virginia as are
granted to them within the territory of Maryland. The said
company shall be subject to the same pains, penalties, and
obligations as are imposed by said acts, and the same rights,
rivileges and immunities which are reserved to the state of
aryland, or to the citizens thereof, are hereby reserved to
the state of Virginia and her citizens, except that the said
company shall not make or authorize to be made any lateral
road or roads within the territory of Virginia, without the
consent of the legislature; that the said road shall strike
Chincoteague Bay’in the county of Accomack, at such point
as said company may determine upon, and that in obtaining
aright of way, or a right to any lands through which the
contemplated railroad may be extended, or to any timber,
gravel, stone or earth, or other material which sball be ne-
cessary to the construction or repair of said road or other
works or necessary buildings within this commonwealth, the
said Worcester railroad company shall proceed in the same
manner as is prescribed by the laws of this state, and not
under the provisions of its said charter or the amendments
thereto, except also that any injury which at any time may
be done within the limits of Virginia to the said road, or
other works or necessary buildings, shall at all times be
punished according to the laws which may be then in force
in this commonwealth for the protection of the public works
of the commonwealth of Virginia.
2. That it shall be lawful for the Worcester railroad com-
pany to acquire in fee simple, by gift or purchase, and to
old, sell, and lease land along its road and within five miles
thereof, and for the payment of the price of ]and so purchased,
to convey the same in trust, and to issue certificates of stock
and bonds, and dispose of such bonds as may be deemed ex-
pedient by it: provided, that the land thus acquired, shall
not, at any one time, exceed one thousand acres, and shall
not be held for a period longer than fifteen years, except for
village lots, stations, depots, machine shops, and other neces-
sary purposes tonnected with the business of the said com-
any. The property of the said company in this state shall
e subject to like taxation with other property therein.
3. The said company is hereby authorized and empowered
to mortgage its property, estate and franchises, including the
pier which it may build in the water at its terminus within
the state of Virginia, to secure the payment of any bonds
which it has issued or may hereafter issue, in pursuance of
its charter and the amendments thereto in the state of Mary-
land, which bonds and mortgage when executed according
to the laws of the state of Virginia and duly recorded, shall
be a lien on the property, estate and franchises of the said
company in the said state of Virginia.
