Chap. 101.—An ACT to amend and re-enact section thirty-seven,
Chapter one hundred and eighteen, Code of eighteen hundred and
seventy-three, in regard to the Recordation of Wills.
Approved February 26, 1876.
1. Be it enacted by the general assembly, That section
thirty-seven of chapter one hundred and eighteen, Code of
eighteen hundred and seventy-three, be amended and re-
enacted so as to read as follows: °
§ 37. Every will or authenticated copy so admitted to re-
cord by any court shall be recorded by the clerk thereof,
and remain in the clerk’s office except during such time as
the same may be carried to another court under a subpoena
duces tecum: provided that an authenticated copy of an
will so recorded, may be recorded in the county or corpora-
tion wherein lies real estate which is devised by said will.
2. This act shall be in force from its passage.
