Chap. 345.—An ACT to incorporate the Presbyterian Cemetry at
Lynchburg.
Approved April 0, 1874.
1. Be it enacted by the general assembly, That T. J. Kirk-
atrick, Amos Bortsford, John Montgomery, F. B. Deane,
William Kennier, Samuel McCorkle, Chas. L. Mosby, J. N.
Gordon, P. Seabury, Thos. L. Johnson, D. B. Payne, James
F. Payne, Daniel Langhorne and L. L. Armestead, of the
Presbyterian churches of the city of Lynchburg, and their suc-
cessors, for the better government and coutrol of the burial
ground now located in said city, known as the Presbyterian bu-
rial ground, be and they are hereby incorporated, by the name
and style of The Presbyterian Cemetery of the city of Lynch-
burg; by which name they shall have perpetual succession
and a common seal, may sue and be sued, implead and be im-
pleaded, and purchase, take, hold and convey, lands, goods
and chattels: provided, that the amount or value of the pro- 5
perty to be held by said cemetery, shall not exceed fifty thou- §
sand dollars, nor the quantity of land held for the purposes
of raid cemetry, to exceed thirty acres.
2. The persons mentioned in the first section, shall have v
ower to fill any vacancies that may occur in their own body °
y death, resignation, removal or otherwise, in accordance
with the deed of Edward Lynch and wife, of date the twen-
ty-second November, eighteen hundred and twenty-three, di-
recting what character of persons shall control and manage
said burial ground; shall have power to make such by-laws, &
rules and regulations, not contrary to the laws of the state,
or of the United States, as they may deem proper for the
good of the cemetery; may appoint a janitor or superinten- J
ent of said cemetery, prescribe his duties, and fix his salary; P
may levy a contribution upon the holders of lots or squares s
of said cemetery, and such other persons as may, by reason
of the ownership of any part of the said cemetery grounds,
be interested therein, for the purpose of maintaining, pre-
serving and beautifying the same: provided, that said con- 4
tribution, so imposed, shall not exceed six per centum of the
value of said lots, squares or parcels of land so held.
3. This act shall be in force from its passage, and subject c
to modification, at the pleasure of the general assembly. c
