Chap. 284.—An ACT providing a remedy against Turnpike Companies
failing to keep their Roads in order. .

1. Be it enacted by the general assembly, That any per- Rex
son or persons aggrieved by the failure of any turnpike com- *"
pany to keep its road in repair, as prescribed by law, may Kee
adopt the remedy provided by the eighth section of the sixty- Gad
first chapter of the Code of eighteen hundred and seventy- © ®
three; or may make complaint in writing to any justice of con
the peace within the township or townships of the county in J™*
which said road or section complained of may lie; and after
service of notice on the said corporation, as prescribed by the
seventh section of the one hundred and sixty-sixth chapter
of said Code, it shall be lawful for such justice to issue his
whrrant against said corporation, requiring it to appear and
answer said complaint; and the said justice shall proceed to
examine and consider the complaint, upon the evidence ad-
duced by both parties, and if of opinion that the complamt
is well founded, he may render judgment against the defen-
dants for such fine, not exceeding twenty dollars, as he may
deem just, or order the toll-gates upon such section or sec-
tions of said road to be thrown open to the public, to Mos
thereon free from toll, until said section or sections shall be
put in good repair, to be ascertained as provided by the
twelfth section of chapter sixty-one of said Code. In any
case arising under this act, the defendant may appeal from
such judgment to the county court, and like proceedings
thereon may be had as upon appeals from other decisions of
justices. .
