Chap. 248.—An ACT to Provide for the Completion of the Black Lick
and Cove Plaster Bank Turnpike in Wythe County.
Approved April 27, 1874.
Whereas it has been represented (to the general assembly)
that about two miles of the Black Lick and Cove Plaster
Bank turnpike, on the south side of Walker’s mountain, in
Wythe county, still remains unfinished, and that the com-
pletion of said section of said turnpike will render it of in-
calculable benefit to said county—
1. Be it enacted therefore by the general assembly, That
it shall be lawfal for the county court of said county, in its
discretion, to direct one or more of the commissioners of
roads in said county, to let said incomplete section of said
turnpike to contract for such time as said court may prescribe,
and the action of said court, in respect thereto, shall conform
to the provisions of sections fifty, fifty-one, fifty-two, fifty-
three, and fifty-four of chapter fifty-two of the Code of eigh-
teen hundred and seventy-three. The board of supervisors
of said county, under the direction of said court, shall pro-
vide in their annual county levy, from year to year, such
sum or sums of money as may be necessary to meet the re-
quirements of any contract made with said county for the
urpose aforesaid: provided, that the total amount levied
or the purpose aforesaid shall not exceed the sum of two
thousand dollars. Said board shall likewise have power, in
their discretion, to erect one or more toll-gates on said sec-
tion of said turnpike, after the same shall have been comple-
ted, at any point or points between the base of said moun-
tain, in Wythe county, to the base of the same in Bland
county, and to collect tolls thereon, subject to the regulations
of the general turnpike laws. So much of said tolls as may
not be required to keep said section of said turnpike in repair
shall go to reimburse the county of Wythe, to the extent of
its sxpenihairs in com voting the same; and after said county
shall have received the full amount so expended, together
‘with interest thereon, the said toll-gates on said section shall
b
,
be discontinued, unless the same be kept up under the pro-
visions of the general laws regulating turnpikes, and not
under the powers granted by this act.
2. This act shall be in force from its passage.
