Chap. 165.—An ACT for the Relief of Ira M. Hurt and Ira Hurt, sure-
ties for Richard A. Hurt, a Lunatic.

Whereas, sometime ago Richard A. Hurt became a lunatic
supposed at the time to be possessed of a considerable estate ;
and whereas his sureties, Ira M. and Ira Hurt, in order to
secure to him the necessary medical treatment and that se-
curity from harm to others as well as himself, did procure
in the Westerm lunatic asylum a place, to be there treated:
for lunacy, and did then and there give a bond for his the
said Richard A. Hurt’s future maintenance and medical treat-
ment at a stipulated sum per month; and whereas the said
Ira M. Hurt did, by appointment of the county court of
Franklin county, become a committee for the said Richard
A. Hurt to take charge of and manage his estate for his
benefit; and whereas the said Ira M. Hurt within the time
prescribed by law, did settle his account as such committee
accounting for all the money which he had, and charging the
estate of the said lunatic with all the money paid out for the
same, the account having been settled by a regular chancery
commissioner of the said county; and whereas the said com-
missioner did find a large balance in favor of said committee
against the estate of the said lunatic, say some one thousand.
tine hundred dollars, which account was duly admitted to
record in the clerk’s office of Franklin county court, and af-
terwards the fact becoming apparent that the said lunatic’s
estate was insolvent, the said sureties, Ira M. and Ira Hurt
did apply to the county court of said county, to make an
order setting forth the facts in the case to meet the by-laws
of the institution made and provided in such cases by the
directors of said institution, whieh the said county court did
do,as will appear from the record of the said court; and
whereas the expenses charged by said institution previous
to the making of the said order by said court, did amount to
the sum of three hundred and three dollars and sixty-nine
tents, the payment of which is now demanded by the steward
of said asylum, and the said sureties are liable to recovery
therefor; now, therefore,
1. Be it enacted by the general assembly, That the said
Ira M. Hurt and Ira Hurt be, and they are hereby released
as sureties for Richard A. Hurt from all liabilities to the said
Western lunatic asylum, at Staunton, Virginia, or to the
state of Virginia previous to their release by the said county
court of Franklin, or afterwards.
2. This act shall be in force from and after its passage.
