Chap. 143.—An ACT to Amend and Re-enact sections 3, 6, 7, 8, 9, and
10 of chapter 89 of the Code of 1878, in relation to the Weighmaster
of Live Stock.

1. Be it enacted by the general assembly, That sections
three, six, seven, eight, nine, and ten of chapter eighty-nine ¢
of the Code of eighteen hundred and seventy-three, be v
amended and re-enacted so as to read as follows: C
“§ 3. The weighmaster shall give a bond in the penalty of +
one thousand dollars, to be approVed by the governor, and
filed in the office of the secretary of the commonwealth.
“§ 6. The weighmaster, by himself or a deputy, shall t
weigh, without unnecessary delay, all live cattle, hogs, and
sheep brought to him to be weighed, and ascertain the gross
weight thereof. He shall enter in a well-bound book, a list
of live stock weighed by him, the kind and weight thereof,
the time when weighed, and the charges therefor.
“§ 7. If the weighmaster delay for six hours to weigh any F
such live stock, he shall pay to the owner thereof ten cents }
on every head of such stock for each hour of such delay be-
ond six hours, Sunday excepted, to be recovered by warrant
fore a justice of the peace, with costs.
“§ 8. If any person shall sell or buy, unless for a certain ¥
price per head, any beef cattle, hogs, or sheep for the sham- “
les within the corporate limits of the city of Richmond, or
within five miles of the same, which have not been raised or
ed three months within said limits, or within five miles
of the same, and which have not been weighed by said weigh-
master, the seller and buyer shall each forfeit and pay a fine P
of not less than one nor more than five dollars for each and §&
every head of cattle, and for each and every hog or sheep a *
fine of not less than fifty cents nor more than one dollar.
All beef cattle shall be sold at the state scales on Thursday r
and Friday of each week, (unless another day shall. be ap-™
pointed by proclamation of the governor, who is hereby vy
authorized to fix another day if it shall be found best to do”
s0,) and any person who shall sell or buy beef cattle at any
other place or time shall be liable to the fines imposed for P
neglecting to weigh on the state scales as aforesaid; one-half
of which penalties shall be to the informer.
“§ 9. There shall be paid to the weighmaster two cents per F
hundred pounds gross weight on all cattle or hogs, and on ”
each sheep per head one cent, for the first time of weighing;
for every second and subsequent weighing, for cattle and hogs,
two cents for every thousand pounds, and for sheep one cent
for every thousand pounds. And said weighmaster shall give
a certificate setting forth the actual gross weight of any oc
number of live stock weighed by him to their owner or his *
agent.
“§ 10. The weighmaster shall monthly return to the audi- ¥
tor of public accounts an abstract from his books of the stock =
weighed by him, and an account of the charges thereon. He «

treasury; and if he violates this section he shall forfeit fifty

Hoga and sheep 2. Be it further enacted, That hogs and sheep may be
may pe reighel weighed at the private scales of brokers by the weighmaster
of brokers = or his deputy, subject to the same terms and penalties as pre-
scribed for stock weighed at the state scales.
Veals and 3. Nothing in this act shall be construed to include veals
lambs excepted or lambs.
Commencement 4. This act shall be in force from and after the first day of
May, eighteen hundred and seventy-four.
