Chap. 127._-An ACT’Incorporating Pamplin City, Virginia.
Approved March 24, 1874.
1. Be it enacted by the general assembly, That the town
of Pamplin, in the counties of Appomattox and Prince Ed-
ward, as the same has been heretofore laid off into lots,
streets, and alleys, shall be, and the same is hereby made a
town corporate by the name of Pamplin City, and by that
name shall have and exercise the powers conferred upon
towns by the fiifty-fourth chapter of the Code of eighteen
hundred and seventy-three, so far as the same is in force;
and shall be subject to and governed by all laws now in
force, or which may hereafter pass, for the government of
towns containing less than five thousand inhabitants.
2. The boundaries of said town shall be as follows, to-wit:
Commencing at a rock imbedded at a persimmon and pine
bush, above Mrs. Lowe’s, running south forty degrees west,
fifty poles, to large white oak on Robert Davis's land; thence
south sixteen degrees west, fifty-six and one-half poles, to
large white oak on Lynchburg road; thence south seven de-
rees east, one hundred and thirty-eight poles, to red oak on
. R. Franklin’s land; thence south thirty-five degrees east,
eighty poles, to white oak; thence south seventy-two degrees
east, one hundred and four and one-half poles, to rock pile on
Elean’s line; thence north thirty degrees east, seventy-six
and three-fifths poles, to white oak; thence north thirty-eight
degrees west, two hundred and forty-three poles, to black
jack on Pamplin’s land; thence north fifteen degrees west,
fifty-six poles, to beginning.
3. The officers of said town shall consist ot five trustees,
who shall compose the council, a majority of whom may con-
stitute a quorum for the transaction of business; ‘and the fol-
lowing named persons shall constitute the board of trustees,
to-wit: John R. Franklin, Thomas P. Mathews, James M.
Couch, E. R. Woodson, and A. M. Jennings, to hold their
office one year from the first of March, eighteen hundred
and seventy-four, or until their successors are elected and
qualified according to law; and the first Tuesday of Feb-
ruary, eighteen hundred and seventy-five, shall be the regu-
lar time for the election of the officers of this corporation,
and every two years thereafter. The board of trustees shall
have power to pass all by-laws and ordinances for the gov-
ernment of said town that they may deem proper, not in
conflict with the constitution of this state or of the United
States, and also to provide for keeping the streets in order,
opening new streets, grading and paving the same, and for
other necessary improvements; for which purpose they may
levy such tax, not exceeding fifty cents on the one hundred
dollars worth of property, as they may deem proper, on all
the property in said town, and on all vocations, professions,
or business as are subject to taxation by the revenue laws of
this state.
4. The board of trustees shall elect from their body a
resident, who shall preside at all thoir meetings when pres-
mt, and when they are equally divided shall, in addition to
is individual vote, give the casting vote. He shall also be
be mayor of the town, and shall be vested with all the pow-
rs of a justice of the peace within the limits of said town,
xcept that no civil warrants shall be tried by him.
5. In addition to the above-named officers, there shall be
\ppointed by the trustees, a town sergeant, who shall be a
-onservator of the peace, and be vested with full power of a
-onstable within the limits of said town, and also have power
,O arrest offenders within one mile of said limits for offences
-Ommitted within the limits of said town. He shall collect
sll the town taxes, and may distrain and sell therefor in hke
manner as a collector of taxes may distrain and sell for State
(axes, and shall have, in other respects, the power to enforce
the collection therefor: provided, however, that no assess-
ment shall be made for taxes on any real estate except the
lands and buildings embraced within the limits of said cor-
poration.
6. This act shall be in force from its passage.
