Chap. 89.—An ACT to Authorize the Board of Supervisors for Wythe
County to Contract for Keeping in Repair certain Public Roads in said
County.
In force Febiuary 17, 1873.
1. Be it enacted by the general assembly, That it shall be
lawful for the board of supervisors of Wythe county, in lieu of
the system now authorized by law for repairing and keeping
the public roads in order, to advertise annually that they will,
on a specified day, receive proposals for keeping any or all of
the turnpike roads in said county in repair, in the manner to
be specified in their stipulations; and they may authorize the
contractors, or other persons appointed by them, to charge and
receive on all persons, animals and vehicles travelling said
roads, the same rate of tolls that were collected by the corpo-
rations that formerly owned and controlled them. Said roads
may be let to contract either as a whole or by specified sec-
tions, and the same person may contract for keeping in repair
one or more of them. Upon the receipt of such proposals they
are hereby authorized to accept the bid which they deem best
for the interest of the people. The said board may thereupor
enter into contract with the party or parties whose proposa
may be accepted, to execute the work according to agreement.

2. Before any such contract shall be binding, it shall be the
duty of the board to submit the same to the county court for
its ratification or disapproval. If the court disapprove there.
of, it shall be set aside; but the contract may be altered or
modified, with the consent of the parties thereto, until ratified
by said court; and thereupon it shall have the force and effect
of a legal obligation, and suits ‘may be instituted and main-
tained in said court upon said bonds, against said contractors
or supervisors, to compel compliance with said obligations.
3. Any contractor, or other person employed to receive tolls
under this act, shall have the same remedies against persons
who fail or refuse to pay the tolls legally charged against
them, that were provided by law in behalf of the companies
which formerly owned said roads.
4. This act shall be in force from its passage.
