Chap. 5.—An ACT Authorizing the Formation of a Sub-School District in
Mt. Gilead and Jefferson townships, in the county of Loudoun, and to
provide for the erection of School Buildings in the same.
Approved December 18, 1872.
1. Be it enacted by the general assembly of Virginia, That it
shall be the duty of the county superintendent of schools in
the county of Loudoun, as soon after the passage of this act as
may be, to convene the school trustees of Mt. Gilead and Jef-
ferson townships, in the town of Hamilton, situated in each of
the said townships, in the county aforesaid, to consider the pro-
priety of forming a sub-school district, to comprise the town of
Hamilton, and so much of Mt. Gilead and Jefferson townships
as said school trustees may agree upon for said purpose, and if,
in their judgment, it should be deemed expedient to form such
sub-district, then it shall be lawful for them to do so, defining
the same by proper metes and bounds.
2. It shall be lawful for the said school trustees of Mt. Gilead
and Jefferson townships, or of either of them, for the use of
said township or townships, to enter into an agreement with
William McCray, Thomas E. Taylor, L. Don Hess, Thaddeus
A. Hatcher, G. V. Braden, Cornelius Shawen and James T.
Robinson, or such persons as may hereafter be appointed trus-
tees of Hamilton Lodge, number thirty-seven, ancient, free, and
accepted masons, for the purpose of erecting a building ona lot.
of ground now owned and held by said Hamilton Lodge, number
thirty-seven ; said building to be used jointly by said school trus-
tees, for school purposes, and by said Hamilton Lodge, number
thirty-seven, which agreement, when entered into, shall be en-
tered of record in the clerk’s office of the county eourt of Lou-
doun, and be binding in law upon the parties making the same:
provided, however, that the said school trustees of Mt. Gilead
township shall not expend a greater sum than six hundred dol-
lars in the erection of said building, unless the excess be raised
by private subscription; and the schooi trustees of Jefferson
township a like sum with the like condition. ;
3. The school trustees of Mt. Gilead and Jefferson townships
shall each, respectively, at the meeting provided for under the
first section of this act, determine the amount of money now in
their hands unexpended, and which can be applied to the erec-
tion of said building, and if they have not a sufficient sum for
sald purpose, they shall each, or either of them, certify that fact
to their respective township boards, at their next annual meet-
ing in June; and the said township boards shall each levy and
cause fo be collected, as other township levies are now collected,
the amount required, subject to the limitation already provided
or.
4, All expenses incurred by the school district hereby cre-
ated shall be borne by Mt. Gilead and Jefferson townships,
ratably and in proportion to the number of pupils from each
township.
5. It shall be lawful for the trustees of Hamilton Lodge,
number thirty-seven, with the consent of the said lodge, to se-
cure, by deed, to the school trustees of Mt. Gilead and Jefferson
townships, for the use of said townships, such right and title in
said property as will protect and secure their interests in the
same.
6. The county superintendent shall give at least ten days
notice of the time and place of meeting of said school trustees ;
and they shall hear such persons as may desire to be heard on
the subject under consideration. The county superintendent
shall preside, and each township shall have an equal number of
votes, and.the superintendent to give the casting vote in case
of a tie.
7. So much of the general school law of this state as is in
conflict with the provisions of this act, shall not apply to the
district hereby created.
8. This act shall be in force from its passage.
