Chap. 368.—An ACT to Amend and Re-enact Section four of Chapter
one hundred and sixty-nine of the Code of Virginia (edition of 1860)
in Regard to Writs of Mandamus, Prohibition and Certiorari. .
Approved April 2, 1873.
1. Be it enacted by the general assembly, That section four
of chapter one hundred and sixty-nine of the Code of Virginia
(edition of eighteen hundred and sixty), be amended and re-
enacted so as to read as follows:
$4. Jurisdiction of writs of mandamus, prohibition and cer-
tiorari (except such as may be issued from the court of appeals)
shall be in the circuit court of the county or corporation in
which the record or proceeding is to which the writ relates.
Any such writ may be awarded either by the circuit court or
(in vacation) by the judge thereof: provided, however, that the
county court in term, or the judge thereof in vacation, shall
have Jurisdiction of writs of mandamus in all matters or pro-
ceedings arising from or appertaining to the action of the
board of supervisors of the county, and the township boards
of the counties for which such county courts are holden.
2. This act shall be in force from its passage.
