Chap. 340.—An ACT to Empower the Board of Supervisors of Chester-
field County to Erect a Fence on and Change the Line of the District
in which the Act Passed January 26, 1866, Commonly called the Fence
Law, is in force. .

1. Be it enacted by the general assembly of Virginia, That
the board of supervisors of the county of Chesterfield shall
have power and authority, in their discretion, at any time within
two years from this date, to construct and keep in repair, upon
the line dividing the district in said county, in which the act
passed January twenty-sixth, eighteen hundred and sixty-six,
commonly called the fence law, is in force, from the residue of
the county, a fence that shall be of the height now required by
law, but to be so canstructed as to be a barrier to horses, mules
and cattle only ; and the said fence shall, when so erected, be
deemed and considered a lawful fence as to such animals only ;
and shall also have power to erect gates across all highways
intersecting said line, except the Manchester and Petersburg
turnpike: provided, that said fence and gates shall be erected
at the exclusive cost and expense of the district so enclosed;
the said amount of cost to be levied by said board, by tax
upon said district, or by private contribution if deemed best.
2. That said board shall have power to change said line at
any time, upon the application in writing of a majority of the
land-owners in the present district and the proposed new dis-
trict; and if at any time said line shall be changed, they shall
have power to construct upon the said new line such fences
and gates as are provided for in the first section, and in the
same manner; and thereupon the provisions of the first sec-
tion shall apply to said new line fence and gates.
3. ‘That the western line of the said district shall be changed
so as to run as follows, to wit: Commencing on the south line
of James river at the western line of C. R. Mason’s farm ;
thence running southwardly with the western line of said-Ma-
son's farm; thence with the exterior line of said Mason’s farm
to the present line of said district: provided, that if the fence
in the first section mentioned be not constructed, the said Ma-
son and the other parties on the new line shall keep up such a
fence on their exterior line as is provided for in said section.
4. This act shall be in force from its passage.
