Chap. 317.—An ACT to Amend and Re-enact Chapter 281, Acts of
1866-’67, and Chapter 252, Acts of 1869-’70, in Relation to the Clinch
River Navigation Company and for other Purposes.

1. Be it enacted by the general assembly of Virginia, That
chapter two hundred and eighty-one, acts of eighteen hundred ¢
and sixty-six and sixty seven, and chapter two hundred and °
fifty-two, acts of eighteen hundred and sixty-nine and seventy, }
entitled an act to amend and re-enact an act to incorporate the P
Clinch River Navigation Company, approved July ninth,
eighteen hundred and seventy, be amended and re-enacted so
as to read as follows:
§1. That for the purposes of opening the Clinch river so far p
as the same passes through Scott county, Virginia, so as to §
admit and facilitate the passage of flat-bottomed boats and ¥
timber rafts, it shall be lawful to open books for subscription,
in shares of ten dollars each. The said books shall be opened
at Osberne’s ford, under the superintendence of Isaac Osberne,
John H. Bickley, William Ramey, James Elam, Henry W. Os-
berne, or any two of them; at Stoney creek, under the super-
intendence of William Gillinwaters, William Flanery, Silas
Frazier, John Owens, Emery Cox, M. S. Salling, or any two of
them; at L. H. Neil’s, under the supervision of Isaac Wolf,
William Horton, James P. Carter, James V. Lyon, or any two
of them.
§2. When fifty shares have been subscribed the said sub-
‘scribers may organize and elect a president and board of di-
rectors, and they are hereby declared a body corporate, by the
name of the Clinch River Navigation Company, and by that
name may sue and be sued, may have a common seal, may pur-
chase and hold real and personal property.
§3. They shall have full power to make such by-laws for their
government as may facilitate their objects and not be in con-
flict with laws now in force.
§ 4. They shall have full power to remove obstructions in said
river and improve the same ; may charge such tolls for the pas-
sage of boats and rafts, and such rents for warehouses as may
be approved by the county court of Scott county and entered
of record; and the said court shall have full power to change
and alter such tolls from time to time as it may deem proper
and just.
§5. All acts and parts of acts inconsistent with this act are
hereby repealed.
_ §6. This act shall be in force from and after its passage.
