Chap. 304.—An ACT to Amend and Re-enact Section one of an Act
passed February 2d, 1865, entitled an Act to Authorize Express and
. other Transportation Companies to sell Unclaimed Freights.

1. Be it enacted by the general assembly of Virginia, That
section one of an act passed February second, eighteen hun-
dred and sixty-five, entitled an act to authorize express, rail-
road and other transportation companies to sell unclaimed
freight, be amended and re-enacted so as to read as follows:
§ 1. That any express or railroad company, or persons en-
gaged in the express business, or in any way in the transporta-
tion of goods or articles of any kind, from one part of the
country to another, as freight or baggage, and having an office
or place of business in the state, who shall have had any un-
claimed articles, goods or things, not perishable, in its, his or
their possession for a period of sixty days at least, may, at the
expiration of that time, proceed to sell the same at public auc-
tion; and out of the proceeds may retain the charges of trans-
portation and storage of such articles, goods or things; which
axpense and charges shall be a lien upon such articles: pro-
vided, that said company, person or persons shall first give
public notice of such sale in one or more newspapers, once a
week for four successive weeks, published at the place nearest
the said place of sale; which notice shall set forth the time
and place of sale, the character of each unclaimed package
distinctly, and the name of the person or persons to whom it
is directed, if known.
2. This act shall be in force from its passage.
