Chap. 294.—An ACT Authorizing the Board of Education to Fund the
Bonds of Virginia Belonging to the Literary Fund.
Approved March 29, 1873.
1. Be it enacted by the general assembly of Virginia, That
the board of education be and said board is hereby authorized
and required to have the bonds of the state of Virginia be- >
longing to the literary fund, funded in accordance with the }
provisions of the act entitled an act to provide for the funding
and payment of the public debt, approved March thirtieth,
eighteen hundréd and seventy-one: provided, that the two-
thirds of said bonds for which the present state of Virginia is
liable, shall be funded in registered bonds of this state, which
registered bonds shall not be convertible into coupon bonds:
provided, however, before the bonds herein directed to be p
funded shall be so changed, it shall be the duty of the attorney
general to examine into the condition of the said bonds, and
ascertain whether or not they are the property of the literary
fund, and as such, whether the board of education have the
power to receive the interest upon said bonds.
2. The certificates given for the third of said’ bonds set a
apart for West Virginia, shall be safely deposited and kept by &
the board of education subject to the provisions of any settle- g
ment which may be had between this state and the state of
West Virginia in reference to the public debt of Virginia, cre-
ated prior to the formation of the state of West Virginia.
3. The auditor of public accounts is hereby authorized and
required, ftom time to time, as the interest becomes due, to
issue his warrants upon the treasury, payable out of any money
therein not otherwise appropriated, in favor of the second au-
ditor, for such amounts as may be necessary to pay the interest
semi-annually accruing upon the registered bonds of this state
hereinbefore authorized to be issued for two-thirds of the ag-
gregate amount of the bonds of the state of Virginia belong-
ing to the literary fund.
4. This act shall be in force from its passage.
