Chap. 26.—An ACT to Authorize Decrees in Chancery Causes to be En-
tered, by Consent of Parties, in Vacation, and to Validate Decrees here-
tofore rendered in Vucation.
Approved January 14, 1873.
1. Beit enacted by the general assembly, That chancery
causes may hereafter, by consent of parties, given in open court
and entered of record, be submitted to the judge of the court
in which such cause is pending for decision or decree, to be
made therein, in vacation, and all decrees so made hereafter
and entered by the clerk in vacation, shall be deemed and taken
to be as valid as though they had been made and entered in
open court.
2. Be it further enacted, that decrees heretofore rendered in
vacation by consent in the manner mentioned in the foregoing
section, shall be, and are hereby declared tobe, as valid as though
they had been made and entered in open court, provided the par-
ties against whom any such decree shall have heretofore been
made shall, either in the appellate court or the court below,
enter of record a waiver of all objection to the validity of such
decree on account of its having been made and entered in va-
cation.
3. This act shall be in force from its passage.
