Chap. 255.—An ACT to Authorize County Courts to Declare Water
Courses Lawful Fences.
Approved March 27, 1873.
1. Be it enacted by the general assembly, That the county
court of any county be authorized, upon a petition of any pro-
prietor or occupant of lands on any stream of water or canal,
to declare and establish the same, or any part of either, within
the limits and jurisdiction of the county, a lawful fence as to
any of the stock named in the eighth section of chapter ninety-
nine of the Code of eighteen hundred and sixty; but notice
of such application must be given by posting such petition on
the front door of the courthouse, and at two or more public
places on or near the stream or canal, or the part thereof to
which said petition applies, for thirty days, and by publishing
the same weekly for four successive weeks in a newspaper, if
one is published in the county; but at or before the trial of
said petition any person interested may enter himself a defend-
ant thereto, and said cause shall thereafter proceed as other
causes on the docket.
2. Said court may, upon lke petition and notice of any
person interested, revoke, amend, modify or change any order
made by it under this act; but such order shall not be made
until at least one year from the date of the original, and shall
not take effect until six months after it is made.
3. This act shall be in force from its passage.
