Chap. 251.—An ACT to Incorporate the Richmond and Fair Oaks Turn-
pike Company, in the County of Henrico.
Approved March 27, 1873.
1. Be it enacted by the general assembly, That for the pur-
pose of constructing a turnpike road from the limits of the
city of Richmond, near Twenty-fifth and Venable streets, to a
convenient and suitable point near the place known as Fair
Oaks, in the county of Henrico, it shall be lawful to open books.
for receiving subscriptions to an amount not exceeding three
thousand dollars, divided into shares of twenty dollars each,
to constitute a joint capital stock. The said books shall be
opened under the direction of Shelton C. Davis, Elijah Baker,
L. S. Courtney, R. M. Thorn, Robert C. Braxton, A. G. Bab-
cock, John Blake, Dr. Hawk, George M. Fleck and Al-
fred Moses, or any two of them, and at such place or places,
and under the superintendence of such agents, as any three of
the above-named persons may appoint.
2. When thirty shares of the capital stock shall have been
‘subscribed, the subscribers, their executors, administrators
and assigns, shall be and are hereby incorporated into & com-
pany, by the name and style of the Richmond and Fair Oaks
Turnpike Company, subject to the provisions of the Code of
Virginia (edition of eighteen hundred and sixty), and all acts
amendatory thereof, applicable to and not inconsistent with the
provisions of this act: provided, that the said company shall
not be,required to make a summer or side road, nor to cover
the said road with stone or gravel; that the road shall be
cleared not less than twenty-five feet wide, and constructed
not less than eighteen feet wide, and that its grade shall nowhere
exceed five degrees. And the said company shall, in addition
to the privileges herein conferred, be and they are hereby au-
thorized to erect gates and charge tolls, according to law, so
soon as a section of five miles shall be completed.
3. Parts of the public road known as the Nine-mile road, or
the bed of any other public road which may lie along the pre-
scribed route of said turnpike, may be taken and used by said
company to construct their road thereon: provided, that the
county court of Henrico shall consent thereto, and | so direct
by an order of court.
4. The said turnpike shall be commenced within one year,
and shall be completed within two years from the organization
of the company.
5. This act shall be in force from its passage.
